Terms and Conditions - OCBC 3% Cashback Promotion May 2012

Terms and Conditions Governing the OCBC 3% Cashback Promotion May 2012 (the "Promotion")

    Promotion Period

  1. The Promotion Period shall be between 15 May to 14 June 2012 (both dates inclusive) (the “Promotion Period”) or such other period as may be determined by Oversea-Chinese Banking Corporation Limited (“OCBC”) in its absolute discretion.

    2. Eligibility

  2. Only customers who meet the following criteria (the “Eligible Cardmembers”) may qualify to participate in the Promotion:-

    a) Existing OCBC Credit Cardmember who has received a short messaging service (“SMS”) text, inviting him/her to participate in this Promotion; and
    b) Such existing OCBC Credit Cardmember whose OCBC Credit Card account is, as determined by OCBC, in good standing with OCBC within the Promotion Period.

  3. The Promotion is applicable to the selected OCBC Credit Cardmembers who have made charges for retail/ cash advance transactions by using their OCBC Credit Cards during the Promotion Period.

  4. The retail spending (including supplementary cardmember’s spending) must be made and posted/reflected in the OCBC Credit Cards account of the Eligible Cardmember within the Promotion Period.

  5. The Eligible Cardmembers must spend the “Required Amount” as stated in the short messaging service (“SMS”) text sent to them on 15 May 2012.

  6. Eligible Cardmembers who charge a minimum of the “Required Amount” to their OCBC Credit Cards during the Promotion Period will be entitled to receive a 3% cashback, capped at S$50.

  7. An Eligible Cardmember can only earn one cashback under this Promotion. The maximum amount of cashback that may be awarded under these terms and conditions is S$50.

  8. Balance transfer transactions, CashWise, Paylite, IPP transactions, bank charges, finance and late charges are not eligible in the computation for the spend required. OCBC Bank reserves the right in its sole and absolute discretion to determine the type of eligible transactions which qualify under the Promotion. This includes without limitation, whether a transaction is to be considered a retail/ cash advance transaction. If OCBC Bank in its sole and absolute discretion decides that any transaction is not to be considered a retail/ cash advance transaction, or that any transaction does not otherwise qualify under the Promotion, the cashback may not be awarded.

    9. Cashback

  9. If eligible, the OCBC Credit Cardmember’s account will be credited with a single payment of the cashback amount within 30 working days after the Promotion ends. The Eligible Cardmember’s account must be active and in good standing at the time of crediting.

  10. The cashback will be computed based on retail/ cash advance transactions made during the Promotional Period on their OCBC Credit Cards.

  11. OCBC reserves the right to select the appropriate credit card account to credit the cashback.

  12. OCBC reserves the right to amend or withdraw this Promotion at any time without prior notice.

  13. Subject to the foregoing, this Promotion is not transferable and not exchangeable for cash, credit or kind.

    14. Miscellaneous

  14. The decision of OCBC on all matters relating to this Promotion will be at its absolute discretion and will be final and binding on all participants. No correspondence shall be entertained. In the event of any inconsistency between these terms and conditions and any brochure, marketing or promotional material relating to the Promotion, these terms and conditions will prevail.

  15. OCBC shall not be responsible for any loss to or expenses incurred by any Eligible Cardmember or any other person in connection with the Promotion, howsoever arising, including any error in computation, any breakdown or malfunction in any computer system or equipment.

  16. OCBC shall not be responsible for the quality, merchantability or the fitness for any purpose or any other aspect of any gift/product. Notwithstanding anything herein, OCBC shall not at any time be responsible or held liable for any defect or malfunction in any gift/product, and/or for any loss, injury, damage or harm suffered or incurred by or in connection with the use of any gift/ product by any person.

  17. OCBC reserves the right at its absolute discretion to terminate this Promotion at any time or vary, delete or add to any of these terms and conditions from time to time without notice including without limitation, the eligibility of any Eligible Cardmember, the methods of computation and the Promotion Period.

  18. These terms and conditions shall be governed by the laws of Singapore and the participants in the Promotion irrevocably submit to the non-exclusive jurisdiction of the courts of Singapore. A person who is not a party to any agreement governed by these terms and conditions shall have no right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any of these terms and conditions.
