Terms and Conditions Governing OCBC Ladies' Circle (the “Programme”) - With Effect 1 July 2009

1. Eligibility
1.1  Only female individual who opens a SmartSavings account or is a holder of an existing SmartSavings account will be automatically included in the Programme.

1.2 In relation to a joint account (which must be a SmartSavings account), only female account holders will be eligible for the Programme. If there is more than one female account holder in a joint account, the Bank shall select in its sole discretion one female account holder as being eligible to participate in the Programme in relation to that joint account.

2. Components of the Programme
2.1
The Program shall comprise of the following:
(i) Ladies' Reward;
(ii) Ladies' SMS; and
(iii) Ladies' Events

3. Ladies' Reward
3.1
Introduction
The Ladies' Reward is a reward programme to reward ladies for discipline savings over a 6-month period.

3.2 Mechanics

3.2.1 To qualify for the Ladies' Reward, the difference between the opening balance and closing balance in the customer's SmartSavings account over a 6-month period must be equal to or greater than S$30,000.

3.2.2 For the purpose of calculating the Ladies' Reward:-
(i) for accounts existing as at 1 July 2009 (“Existing Accounts”), the opening balance (equivalent to the day-end account balance of the customer's SmartSavings account on the previous business day) in relation to the calendar semi-annual period  shall be as 1 July 2009, and for subsequent calendar semi-annual period, shall be the first business day of the next calendar semi-annual period;

(ii) for accounts which are not in existence as at 1 July 2009 (“New Accounts”), the opening balance (equivalent to the day-end account balance of the customer's SmartSavings account on the previous business day) in relation to the first calendar semi-annual period shall be taken on the date of opening of the account and for subsequent calendar semi-annual period, shall be taken on the first business day of the calendar semi-annual period;

(iii) for both Existing Accounts as well as New Accounts, the closing balance is taken on the last business day of every calendar semi-annual period and shall be equivalent to the day-end account balance of the customer's SmartSavings account on such business day; and

(iv) in the event that a customer has more than one SmartSavings account, each SmartSavings account will be considered on a stand-alone basis and no aggregation of the account balances in different SmartSavings accounts will be allowed.

(v) if the Bank (in its absolute discretion) deems that any customer with more than one SmartSavings Account has moved funds from one account to another for the purpose of qualifying for the Ladies' Reward, the Bank has the absolute discretion to consider such customer to have violated the qualification criteria and the Bank has the absolute discretion to disqualify such a customer from the Ladies' Reward.

3.2.3 A redemption letter will be sent to qualified customers' mailing address on the Bank's record informing them to redeem their rewards. All rewards must be redeemed within the period as determined by the Bank in its sole discretion and specified by the Bank in the SMS

3.2.4 No redemption letter will be sent to a customer who does not meet the criteria in clause 3.2.1 or 3.2.2.

3.2.5 Customers will need to produce their identity card as well as the redemption letter to redeem the rewards which can be done at any of our selected branches.

3.2.6 Customers will need to sign on the acknowledgment form upon collection of the rewards.

3.2.7 Each customer is entitled to only 1 reward per SmartSavings account per calendar semi-annual period.

4. Ladies' SMS
4.1
The Bank may at any time at its absolute discretion send updates, details of any events or contest and any promotional message through short message service (SMS) to the customer's mobile number on the Bank's record.

 


5. Ladies' Events
5.1 The Bank shall organize mini events which are catered exclusively for members of the Programme.

5.2 Invitations to such mini events shall be at the Bank's sole discretion and the Bank reserves the right not to extend invitation to all members of the Programme.

6. General
6.1 All rewards shall be accepted on an "as is" basis. OCBC Bank gives no representation or warranty whatsoever as to the quality, merchantability or fitness for purpose or any other implied terms or conditions with respect to any reward. Notwithstanding anything herein, OCBC Bank shall not at any time be responsible or held liable for any defect or malfunction in any reward, and/or for any loss, injury, damage or harm suffered or incurred by or in connection with the use of any reward by any person. All rewards are neither transferable nor exchangeable for cash, credits or otherwise. All rewards are also subject to the terms and conditions accompanying them (if any).

6.2 OCBC Bank reserves the right, at its discretion, at any time, without notice or assigning any reason therefore, replace or substitute any reward under the Programme with any other item of equal or similar value selected by OCBC Bank.

6.3 If OCBC Bank subsequently discovers that any person is in fact not eligible to participate in the Programme or entitled to any reward, OCBC Bank may at its discretion forfeit the reward(s) (or reclaim it /them if already awarded) and award or dispose of it/them in such manner and to such person/persons as OCBC Bank deems fit. No person shall be entitled to any payment or compensation from OCBC Bank should any reward be forfeited.

6.4 OCBC Bank shall not be liable to any account holder or any other persons for any loss or damage arising in connection with the Programme, including without limitation, any error in computing any chances, any breakdown or malfunction in any computer system or equipment. Without prejudice to the generality of the foregoing, OCBC Bank assumes no responsibility for lost, late, misdirected, damaged, incomplete, illegible and/or postage-due mail.

6.5 The decision of OCBC Bank on all matters relating to the Programme shall be final and binding on all participants of the Programme, including, without limitation, any decision to cancel or suspend the Programme. Subject to and without prejudice to the generality of the foregoing, OCBC Bank's record(s) relating to the Programme shall be final, binding and conclusive for all purposes and in any legal proceedings. No correspondence will be entertained.

6.6 In the event of any inconsistency between these terms and conditions and any brochure, marketing or promotional material relating to the Programme, these terms and conditions shall prevail.

6.7 OCBC Bank may at any time at its absolute discretion, without notice or assigning any reason therefore, delete, vary, supplement, amend or modify any one or more of these terms and conditions in such manner as OCBC Bank shall think fit, including without limitation, the eligibility of any customer, the bases and methods of identification of any person who is eligible to recieve rewards under the Programme (the "Relevant person") and any dates in connection with the Ladies' Reward. OCBC Bank shall not, to the extent permitted by law, be liable to for any claims, costs, expenses, loss or damage suffered by any person as a result of the aforementioned matters.

6.8 Each Relevant Person shall cooperate with OCBC Bank and participate in any advertising or publicity activities of OCBC Bank relating to the Programme and agrees that OCBC may publicise the name, NRIC/passport number and/or photograph the Relevant Person in such mode and manner as OCBC Bank considers fit.

6.9 Without prejudice to these terms and conditions, all participants in the Programme expressly and irrevocably permit and authorize OCBC Bank to disclose, reveal and divulge information regarding their particulars to the parties involved in organizing, promoting and conducting the Programme.

6.10 These terms and conditions shall be governed by the laws of Singapore and the participants in the Programme irrevocably submit to the non-exclusive jurisdiction of the courts of Singapore.

6.11 A person who is not a party to any agreement governed by these terms and conditions shall have no right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any of these terms and conditions. OCBC Bank reserves the right, at its discretion, at any time, without notice or assigning any reason therefore, replace or substitute any reward in the Programme with any other reward of equal or similar value selected by OCBC Bank.

6.12 OCBC Bank may at any time at its absolute discretion, without notice or assigning any reason therefore, delete, vary, supplement, amend or modify any components of the Programme in such manner as OCBC Bank shall think fit.
