Terms and conditions for Funds Transfers via the OCBC PayNow Service

  • Introduction
    1. These terms and conditions ("Terms") apply to and regulate your use of the PayNow service offered by Oversea-Chinese Banking Corporation Limited Singapore (the "Bank") in accordance with these Terms ("OCBC PayNow Service"). The OCBC PayNow Service allows you (a "Payer") to request (each such request a "Transaction Request") that the Bank carry out a transaction (a "PayNow Transaction") to transfer an amount specified by you ("Transfer Amount") from your designated OCBC bank account to the PayNow Account (defined below) maintained by your designated recipient ("Recipient") with a participating bank or participating e-wallet provider under PayNow (being the Association of Banks in Singapore ("ABS")-led initiative designated and marketed as such by ABS), where the Recipient is either identified through:
      1. A "Proxy" (being a unique identifier of the Recipient (such as the UEN or UEN plus suffix combination of the Recipient, the VPA of the Recipient or the Recipient's mobile number or NRIC, as the case may be) designated as such by the Recipient's bank or e-wallet provider where applicable and registered as such under PayNow). For the avoidance of doubt, "UEN" refers to the Unique Entity Number which serves as a standard identification number for an entity and which is issued by the applicable Unique Entity Number issuance agencies, "VPA" means the Virtual Payment Address which serves as an alphanumeric identification code for an e-wallet issued by a participating e-wallet provider under PayNow to either an individual with a retail account or an entity with a corporate account with such participating e-wallet provider.
      2. a unique two-dimensional barcode generated by the Bank ("QR Code"); or
      3. such other means prescribed by the Bank from time to time.
    2. The following types of PayNow Transactions may be carried out via the OCBC PayNow Service:
      1. transactions pursuant to a Transaction Request submitted through the OCBC Pay Anyone™ application, the OCBC Digital application, or through the OCBC Internet Banking Service and/or OCBC Mobile Banking Service (or to such other Electronic Banking Service as prescribed by the Bank from time to time) by which the Recipient is identified through their relevant Proxy ("Proxy Transactions"); and
      2. transactions pursuant to a Transaction Request submitted through the OCBC Pay Anyone™ application and/or OCBC Digital application by which the Recipient is identified through the relevant QR Code ("QR Transactions").
      The term "OCBC PayNow Service" shall be deemed to include any notifications, communications or services referred to in these Terms and/or any services, functions and features made available through such part of the Electronic Banking Services which relates to or forms part of any PayNow Transaction. For the avoidance of doubt, the "Electronic Banking Services" shall mean the OCBC Internet Banking Service, OCBC Mobile Banking Service, OCBC Phone Banking Service, OCBC ATM Service and/or any other services provided or made available under the OCBC Terms and Conditions governing Electronic Banking Services.
    3. The OCBC PayNow Service is provided as part of the Electronic Banking Services, and accordingly these Terms are in addition to and shall be read in conjunction with:
      1. the OCBC Terms and Conditions governing Electronic Banking Services (any reference to the relevant Electronic Banking Service in the OCBC Terms and Conditions governing Electronic Banking Services shall include a reference to the OCBC PayNow Service); and
      2. (where applicable) the Terms and Conditions for OCBC Pay Anyone™ Service (in particular, the Terms and Conditions for OCBC Pay Anyone™ QR Service where QR Transactions conducted through the OCBC Pay Anyone™ application are concerned),
      provided that in the event of conflict or inconsistency, these Terms shall prevail over the OCBC Terms and Conditions governing Electronic Banking Services and/or the Terms and Conditions for OCBC Pay Anyone™ Service (as the case may be) to the extent of such conflict or inconsistency.
    4. You must accept and agree to these Terms, the OCBC Terms and Conditions governing Electronic Banking Services and Terms and Conditions for OCBC Pay Anyone™ Service ("OCBC PAO Service") (as the case may be) before you are able to use the OCBC PayNow Service. You further agree to comply with all guidelines, policies and procedures pertaining to use of the OCBC PayNow Service issued by or on behalf of the Bank from time to time. By accepting and agreeing to these Terms, you acknowledge and agree that you have successfully opted-in for the OCBC PayNow Service and unless the Bank prescribes otherwise, will be able to perform ad-hoc transfer of funds without the need for Transaction Signing (to secure and authorise transactions) or to set-up a pre-authorised account for such transfers. The Bank may still impose further security or authorisation steps (including Transaction Signing) for certain types of transfers of funds at its sole discretion (e.g. for certain transactions that the Bank deems are high risk transactions). For a PayNow Transaction to be conducted, you will need to:  
      1. be a retail customer of the Bank with a valid and active Singapore dollar current or savings account with the Bank ("Account"); and
      2. be a valid user of the relevant Electronic Banking Service prescribed by the Bank from time to time through which the PayNow Transaction is to be carried out;
      3. (where appropriate) have installed the OCBC Pay Anyone™ application on your mobile phone and be a valid user of the OCBC PAO Service;
      4. (where appropriate) have installed the OCBC Digital application on your mobile phone and be a valid user of the OCBC Digital Transaction Services; and
      5. comply with these Terms,

    and the Recipient must maintain a valid and active account or e-wallet, and be a registered user under PayNow, with a participating bank or participating e-wallet provider under PayNow (each such user, a "Registered PayNow User").
    As used in these Terms: (i) the term "Transaction Signing" means such security measure as may be prescribed by the Bank, which may require you to key in transaction-specific information into a Security Device to generate an OTP in order to proceed with such transaction; (ii) "Security Device" means any hardware, token or device that may be issued by or on behalf of the Bank, at any time from time to time in its sole and absolute discretion, for the purposes of authenticating your access and/or use of the OCBC Internet Banking Service; and (iii) "OTP" means each one-time password valid for one session or transaction which will be issued by the Bank through the Security Device or delivered to your designated telephone number via Short Message Service ("SMS"), or otherwise generated by or delivered via any other device, delivery channel or any means whatsoever, designated by the Bank at any time from time to time in its sole and absolute discretion.be a retail customer of the Bank with a valid and active Singapore dollar current or savings account with the Bank ("Account"); andbe a valid user of the relevant Electronic Banking Service prescribed by the Bank from time to time through which the PayNow Transaction is to be carried out;(where appropriate) have installed the OCBC Pay Anyone™ application on your mobile phone and be a valid user of the OCBC PAO Service;
  • OCBC PayNow Service in relation to Proxy Transactions
    1. Where the relevant PayNow Transaction is a Proxy Transaction, the provisions of this Section titled "OCBC PayNow Service in relation to Proxy Transactions" will apply.
    2. If you wish to carry out a Proxy Transaction, you must first submit a "Look-Up Request" through the OCBC PAO Service, the OCBC Internet Banking Service and/or OCBC Mobile Banking Service (or to such other Electronic Banking Service as prescribed by the Bank from time to time) to initiate the first step in making a Transaction Request, by providing such information as may be requested by the Bank (such as the Recipient's mobile number, NRIC number, VPA or UEN number) which corresponds to the Recipient's Proxy.
    3. If the information you submit via a Look-Up Request corresponds to a Registered PayNow User's registered proxy under PayNow, you will be shown (via a display on the relevant screen) the name of the Registered PayNow User such as the applicable registered entity name ("Name"), or the "Nickname" of such Registered PayNow User (being the nickname or alias of such Registered PayNow User as designated under PayNow), as the case may be, and where applicable, the name of the e-wallet to which the Registered PayNow User’s registered proxy under PayNow is linked ("E-Wallet Name"). In order to submit the Transaction Request, you will be required to take such further steps as required by the Bank (such as pressing a "Next" or "Submit" button and/or keying in your security credentials to indicate your intention to confirm and submit such Transaction Request). Before submitting a Transaction Request, you are responsible for checking the Name or Nickname (as the case may be) and, where applicable, E-Wallet Name displayed and for ensuring that the relevant Registered PayNow User is the intended Recipient of the funds. The Bank shall be in no way liable to you for any losses, liabilities, costs, expenses damages, claims, actions or proceedings of any kind whatsoever in connection with your failure to take any and all precautions to ensure that said Registered PayNow User is the intended Recipient of the funds.
    4. You acknowledge and agree that the Registered PayNow User whose Name, Nickname or E-Wallet Name is displayed shall be deemed to be the Recipient, the Bank shall have no duty to and shall not be required to take any steps to verify or seek any other confirmation from any party as to whether such Registered PayNow User is the intended Recipient or that the bank account or e-wallet designated by such person is that of the intended Recipient, and the Bank shall not be liable for transferring the Transfer Amount to such Registered PayNow User even if such person is not the intended Recipient (regardless of whether such transfer is to the intended Recipient’s designated bank account or e-wallet).
    5. The Bank reserves the right to impose limits on the number of Look-Up Requests you may submit. Without prejudice to any of the Bank's rights and remedies (including without limitation under paragraph 14 of the Section titled "Miscellaneous" below), the Bank reserves the right to terminate or suspend your access to and use of the OCBC PayNow Service where the number of Look-Up Requests submitted exceeds the limit imposed by the Bank or where it considers in its sole discretion that inappropriate or suspicious use is being made of the service, such as where multiple Look-Up Requests are submitted without a Transaction Request being confirmed. You are advised to refrain from submitting multiple Look-Up Requests without submitting a Transaction Request, and to contact the Bank should you encounter any issues relating to the foregoing.
  • OCBC PayNow Service in relation to QR Transactions

    Where the relevant PayNow Transaction is a QR Transaction, (i) where the QR Transaction is conducted through the OCBC Pay Anyone™ application, the Terms and Conditions for OCBC Pay Anyone™ QR Service will additionally apply, and (ii) where the QR Transaction is conducted through the OCBC Digital application, the OCBC Terms and Conditions governing Electronic Banking Services, will additionally apply.

  • Miscellaneous
    1. Once such a request has been submitted, it will be deemed irrevocable and you will not be able to withdraw, cancel or make any changes to such request. Depending on the nature of the request, you may be able to submit a new request to supersede the submitted request.
    2. The Bank shall be entitled, at its absolute discretion, to reject or refuse to accept or process or to cancel any such request and shall not be required to give any reason for the same.
    3. In relation to each request in relation to your usage of the OCBC PayNow Service:
      1. You hereby instruct and authorise the Bank to carry out and process such request.
      2. You acknowledge and agree that the Bank need not process the PayNow Transaction or transfer the Transfer Amount if there are insufficient funds in your Account.
      3. In relation to PayNow Transactions and Non-PayNow QR Transactions (as defined in the Terms and Conditions for OCBC Pay Anyone™ Service where conducted through the OCBC Pay Anyone™ application, or as defined in the OCBC Terms and Conditions governing Electronic Banking Services where conducted through the OCBC Digital application and in either case where the relevant Third Party Provider (as defined in the Terms and Conditions for OCBC Pay Anyone™ via QR Service where conducted through the OCBC Pay Anyone™ application, or as defined in the OCBC Terms and Conditions governing Electronic Banking Services where conducted through the OCBC Digital application) is NETWORK FOR ELECTRONIC TRANSFERS (SINGAPORE) PTE. LTD. (“NETS”)), the amount that you may transfer (whether pursuant to a single or multiple Transaction Requests) is subject to a default shared aggregate daily limit of S$1,000, and should you choose to update such shared aggregate daily limit , up to a maximum shared aggregate daily limit of S$200,000 (S$300,000 for Premier customers and above).
        In relation to Passcode Transactions (as defined in the Terms and Conditions for OCBC Pay Anyone™ Service) and any other transaction not described above, including Cross-Border PayNow Transactions (as defined in the Terms and Conditions for Funds Transfer via the OCBC Cross-Border PayNow Service), the amount that you may transfer (whether pursuant to a single or multiple Transaction Requests) is subject to a shared aggregate daily limit of S$1,000.
        This limit is reset at midnight (Singapore time) daily. The Bank may, at its absolute discretion, alter any limit or impose additional limits on the Transfer Amount(s) that may be transferred by you, whether on a per transaction basis, per type of transaction basis, or an aggregated basis, without prior notice to you.
        You may refer to this table for the various daily transaction limits described above.
      4. If the PayNow Transaction is unsuccessful (as determined pursuant to paragraph 4(c)(i)) but the Transfer Amount has been debited from your Account, the Bank shall, where the Bank is in possession of the Transfer Amount or upon receipt by the Bank of the Transfer Amount, arrange for the Transfer Amount to be credited back to your Account. For the avoidance of doubt, you will not be entitled to receive any interest in respect of the Transfer Amount.
    4. The Bank shall, based on the manner of notification pursuant to paragraph 6, notify you where the request has been successfully received and processed, or your request has not been successfully received and processed.

      The Bank shall, based on the manner of notification pursuant to paragraph 6, notify you where:

      1. the Transfer Amount has been successfully debited from your Account, or the Transfer Amount has not been debited from your Account, or has failed to be credited to the PayNow Account (i.e. the PayNow Transaction is unsuccessful), and/or
      2. (if applicable in connection with a PayNow Transaction) your PayNow daily withdrawal limit has been successfully changed, or your PayNow daily withdrawal limit has not been successfully changed.
    5. The Bank reserves the right to impose charges or to revise at any time such charges for the use of the OCBC PayNow Service upon written notice to you. Such charges or revisions shall take effect from the date stated in the notice. Where you continue to access or use the OCBC PayNow Service, you shall be deemed to have agreed to and accepted such charges or revisions to such charges.
    6. The OCBC PayNow Service is provided "as is" and "as available". The Bank expressly excludes any guarantee, representation, warranty, condition, term or undertaking of any kind, whether express or implied, statutory or otherwise, relating to or arising from the access to or use of, the OCBC PayNow Service or in relation to the processing of or any other matter relating to any Transaction Request or PayNow Transaction. Without prejudice to the foregoing, the acceptance by the Bank of your submission of a Look-Up Request and/or Transaction Request does not amount to a representation or warranty by the Bank that it will, and does not impose any obligation on the Bank to, process the PayNow Transaction or transfer the Transfer Amount to the Recipient's PayNow Account and the Bank does not represent or warrant that:
      1. the OCBC PayNow Service will meet your requirements;
      2. the OCBC PayNow Service will always be available, accessible, function or inter-operate with any network infrastructure, system or such other services as the Bank may offer from time to time; or
      3. your use of the OCBC PayNow Service or the processing of any Look-Up Request, Transaction Request or PayNow Transaction will be uninterrupted, timely, secure or free of any malware or error.
    7. You acknowledge that PayNow is operated by Banking Computer Services Private Limited (the "Service Provider") and is provided by the Service Provider to the Bank and other participating banks and participating e-wallet providers, to enable you to access and use the OCBC PayNow Service, and that the access and use of the OCBC PayNow Service may be subject to the availability of the services of the Service Provider.
    8. You acknowledge and agree that, unless expressly prohibited by mandatory laws, the Bank shall not be liable to you for any and all losses, liabilities, costs, expenses, damages, claims, actions or proceedings of any kind whatsoever (whether direct, indirect or consequential) in respect of any matter of whatever nature and howsoever arising (whether in contract, tort, negligence or otherwise) in connection with:
      1. the provision by the Bank of or your use of the OCBC PayNow Service;
      2. the processing of any Look-Up Request, Transaction Request or PayNow Transaction;
      3. any PayNow Transaction being unsuccessful or considered as unsuccessful or any Transfer Amount not having been transferred to the Recipient's PayNow Account or transferred to a recipient other than the intended Recipient, whether or not arising from:
        1. your negligence, misconduct or breach of any of these Terms (including as a result of inaccurate information being provided by you and/or a failure to check the Name, Nickname or E-Wallet Name displayed before submitting a Transaction Request); or
        2. any failure, refusal, delay or error by any third party or third party system (including PayNow or FAST payment system) through whom or which any PayNow Transaction is made;
      4. any unauthorised access and/or use of your personal computers or other access devices (including without limitation mobile phone, television and electronic wearables) the OCBC Pay Anyone™ application, and/or the OCBC Digital application;
      5. the use in any manner and/or for any purpose whatsoever by any person at any time whatsoever and from time to time of any information or data:
        1. relating to you and/or any Recipient;
        2. transmitted through your use of the OCBC PayNow Service; and/or
        3. obtained through your use of the OCBC PayNow Service;
      6. any event the occurrence of which the Bank is not able to control or avoid by the use of reasonable diligence; and/or
      7. the suspension, termination or discontinuance of the OCBC PayNow Service.
    9. The Bank shall not be liable to you for any indirect, special or consequential loss, damage, costs, expenses or liability suffered or incurred by you or any third party, howsoever caused.
    10. Unless expressly prohibited by mandatory laws, the Bank's liability to you arising from or in respect of each PayNow Transaction, whether in contract, tort (including negligence or breach of statutory duty) or otherwise for any and all losses, damages or liabilities caused or arising from or in relation to the Bank's provision of the OCBC PayNow Service and/or under or relating to these Terms shall not exceed the Transfer Amount in respect of such PayNow Transaction.
    11. You shall indemnify, defend and hold harmless the Bank and its representatives, affiliates and service providers from and against any consequences, claims, proceedings, actions, losses, damages, costs (including all legal costs on an indemnity basis), liabilities or expenses, whether foreseeable or not, resulting from or arising in connection with any fault, act or omission by you (including but not limited your negligence, misconduct or breach of any of these Terms).
    12. You represent and warrant that, in relation to each PayNow Transaction, you have obtained the necessary consent of the relevant Recipient to disclose such Recipient's personal data (where applicable, including contact details) to the Bank, ABS (PayNow being an initiative led by it), Service Provider and each of their representatives, affiliates and service providers and for the Bank, ABS (PayNow being an initiative led by it), Service Provider and each of their representatives, affiliates and service providers to use and disclose such Recipient’s personal data as required for the purposes of the OCBC PayNow Service.
    13. The Bank shall be entitled to exercise any of its rights and remedies under the OCBC Terms and Conditions governing Electronic Banking Services (including the right to withdraw, restrict, suspend, vary or modify the Electronic Banking Services (whether in whole or in part)).

Terms and conditions for Registration for the OCBC PayNow Service

  • Introduction
    1. These terms and conditions ("Terms") apply to and regulate your use of the PayNow service offered by Oversea-Chinese Banking Corporation Limited Singapore (the "Bank") in accordance with these Terms ("OCBC PayNow Service") to inter alia register under PayNow (being the Association of Banks in Singapore ("ABS")-led initiative designated and marketed as such by ABS) in order to receive payments of specified amount of funds ("Transfer Amount") from retail customers ("Payers") of participating banks under PayNow ("Payer Banks") who have requested the Payer Bank to transfer the Transfer Amount to your PayNow Account (as defined below) by identifying such account through your Proxy (as defined below) or such other means prescribed by the Bank from time to time, such as a unique two-dimensional barcode generated by the Bank ("QR Code") (each transfer to you of a Transfer Amount, a "PayNow Transaction"). The term "OCBC PayNow Service" shall be deemed to include any notifications, communications or services referred to in these Terms and/or any services, functions and features made available through such part of the Electronic Banking Services which relates to or forms part of any PayNow Transaction. For the avoidance of doubt, the "Electronic Banking Services" shall mean the OCBC Internet Banking Service, OCBC Mobile Banking Service OCBC Phone Banking Service, OCBC ATM Service and/or any other services provided or made available under the OCBC Terms and Conditions governing Electronic Banking Services.
    2. The OCBC PayNow Service is provided as part of the Electronic Banking Services, and accordingly these Terms are in addition to and shall be read in conjunction with:
      1. the OCBC Terms and Conditions governing Electronic Banking Services (any reference to relevant Electronic Banking Services in the OCBC Terms and Conditions governing Electronic Banking Services shall include a reference to the OCBC PayNow Service),
      2. (where applicable) the Terms and Conditions for OCBC Pay Anyone™ Service (in particular, the Terms and Conditions for OCBC Pay Anyone™ QR Service where the PayNow Transaction in question involves the use of a QR Code and is conducted through the OCBC Pay Anyone™ application),
      provided that in the event of any conflict or inconsistency, these Terms shall prevail over the OCBC Terms and Conditions governing Electronic Banking Services to the extent of such conflict or inconsistency.
    3. You must accept and agree to these Terms and be registered as an OCBC PayNow User (as defined below) before you will be able to receive the Transfer Amount which is the subject of a PayNow Transaction. You further agree to comply with all guidelines, policies and procedures pertaining to use of the OCBC PayNow Service issued by or on behalf of the Bank from time to time.
  • Registration
    1. In order to be registered to receive funds through the OCBC PayNow Service, you will need to:
      1. be a retail customer of the Bank with a valid and active Singapore dollar current or savings account with the Bank ("Account");
      2. be a valid user of the relevant Electronic Banking Services prescribed by the Bank from time to time;
      3. comply with the Bank's guidelines, policies and procedures pertaining to the registration of OCBC PayNow Users issued from time to time, including without limitation those set out in these Terms;
      4. not be registered as a user under PayNow with a different participating bank; and
      5. comply with these Terms,
      (each such user registered by the Bank at its absolute discretion from time to time, an "OCBC PayNow User"). You shall not submit a "Registration Request" (being a request to be registered as an OCBC PayNow User) if you are currently registered as a user under PayNow with another participating bank - if you wish to be registered as an OCBC PayNow User, you shall first de-register yourself and your NRIC and/or mobile number as a user and proxy respectively under PayNow by completing the relevant de-registration procedures prescribed by the relevant third party bank.
    2. As part of a Registration Request, you may from time to time submit a "Registration Enquiry" by clicking "Register or Manage PayNow Account" to check if you are currently registered as an OCBC PayNow User (and/or if an account in your name or your mobile number is currently registered (whether by you or another party) as a Proxy under PayNow).
    3. To register as an OCBC PayNow User, you will need to make a Registration Request by following the following steps:
      1. log in to your OCBC Internet Banking Service and/or OCBC Mobile Banking Service account (or to such other Electronic Banking Service as prescribed by the Bank from time to time) using the security credentials issued to you by or on behalf of the Bank;
      2. designate your NRIC number and/or mobile number as your "Proxy" (being a unique identifier of you which meets the Bank's requirements which will be registered as such under PayNow). Customers of participating banks under PayNow will be able to carry out "Look-Up Requests" (being electronic requests by such customers to identify you by your Nickname (as defined below)), if they are in possession of your Proxy; and
      3. designate a valid and active account you maintain with the Bank as the Account to be linked to your Proxy to receive Transfer Amounts pursuant to transfers under PayNow (such Account, the "PayNow Account");
      4. designate a nickname or alias (a maximum of 140 characters long) (such nickname or alias, the "Nickname"), to be accepted by the Bank in its sole discretion, which will be linked to your Proxy and PayNow Account, and will be displayed or otherwise made available to any customer of a participating bank under PayNow who carries out a Look-Up Request using your Proxy. As your Nickname will be displayed to the relevant parties as a security measure for confirming your identity as the intended recipient of the relevant funds, it is highly important that you select a Nickname which is appropriate for the purposes (i.e. a nickname or alias by which you are generally known or by which you are known amongst prospective Payers).
      You agree that each Registration Request is irrevocable once made and you will not be able to withdraw, cancel or make any changes to such Registration Request.
    4. In order to register your NRIC number or mobile number as your Proxy, such NRIC number or mobile number must not be:
      1. currently registered as a proxy by another person with any participating bank under PayNow; or
      2. currently registered as a proxy by you under any other participating bank under PayNow other than the Bank (in order to register such NRIC number or mobile number as a Proxy with the Bank, you will first have to de-register such number with the other bank by completing the de-registration procedures prescribed by such bank).
      In order to register your mobile number as your Proxy, your mobile number must currently be registered with the Bank as your mobile number to receive "SMS OTP" (being a password issued by the Bank through Short Message Service ("SMS") that is only valid for one session or transaction, for the purpose of authentication). You agree and consent that whilst the Bank has no obligation to do so, the Bank may contact you from time to time (whether by way of SMS or telephone call) at such mobile number for authentication purposes and/or to confirm the ownership of such mobile number. You agree to inform the Bank as soon as practicable (but in any case within three (3) working days) of any changes to your mobile number. You agree and accept that possible consequences of you failing to do so include without limitation the automatic deregistration of you and/or your Proxy as an OCBC PayNow User within five (5) working days should the Bank be unable to contact you through such mobile number.
    5. Once registered, you acknowledge and agree that any information you have provided in registering for the OCBC PayNow Service (in particular your Nickname) may be retrieved by any third party who uses the OCBC PayNow Service or who uses the payment services of the banks participating in PayNow.
  • De-Registration
    1. You may de-register yourself as an OCBC PayNow User or a specific Proxy by submitting a de-registration request through the OCBC Internet Banking Service and/or OCBC Mobile Banking Service (or such other Electronic Banking Service as prescribed by the Bank from time to time) ("De-Registration Request").
    2. If you have already registered as an OCBC PayNow User but would like to register yourself or your mobile number with a different bank as a user or proxy (as the case may be) under PayNow, you shall first complete the de-registration process prescribed by the Bank from time to time including submitting a De-Registration Request.
    3. You agree that each De-Registration Request is irrevocable once made and you will not be able to withdraw, cancel or make any changes to such De-Registration Request. Without prejudice to any of the Bank's rights and remedies, you agree that the Bank may terminate your access and/or use of the OCBC PayNow Service by de-registering you and/or your Proxy (without you having submitted a De-Registration Request) from time to time, including but not limited to automatic de-registration within five (5) working days where the Bank has reason to believe that you no longer own or possess the relevant mobile device and/or mobile number registered as your Proxy, or when your PayNow Account is closed.
  • Receiving payment through the OCBC PayNow Service
    1. You agree to inform the Bank immediately of any transfers in respect of which you believe or have reason to suspect: (a) you are not the intended recipient; or (b) constitute, in whole or in part, directly or indirectly, benefits of criminal or illegal conduct. You understand that failure to do so may result in the commission of a criminal offence. Where you have not so notified the Bank, you shall be deemed to warrant that you are the intended recipient of the Transfer Amount.
    2. If a PayNow Transaction cannot be or is not completed for any reason, the Bank shall not be liable to you in respect of the incomplete PayNow Transaction, including without limitation, your non-receipt of the Transfer Amount.
    3. The PayNow Transaction shall be considered as incomplete if the Transfer Amount fails to be credited to the PayNow Account for any reason (whether by reason of a failure in PayNow, FAST payment system or otherwise).
    4. The Bank shall be entitled, at its absolute discretion, to reject or refuse to accept or process or to cancel any Registration Enquiry, Registration Request or De-Registration Request and shall not be required to give any reason for the same. In addition, the Bank shall be entitled, at its absolute discretion, to reject or refuse to process any PayNow Transaction and shall not be required to give any reason for the same.
  • Miscellaneous
    1. You agree to receive notifications (by or on behalf of the Bank or its service providers) in relation to PayNow Transactions and/or the OCBC PayNow Service by (i) SMS, (ii) push notification (where applicable), (iii) email, and/or (iv) such other media as the Bank may deem appropriate. All notifications to be sent to you under these Terms:
      1. by SMS will, if you have a valid mobile number registered with the Bank, be sent to such valid mobile number (where such notification relates to any automatic de-registration of your mobile number or any De-Registration Request such telephone call or SMS shall be to your alternate mobile number on record (if any));
      2. by push notification (where applicable) will be sent via the OCBC Pay Anyone™ application or OCBC Digital application on your mobile phone, as the case may be;
      3. by email will be sent to your valid email address registered with the Bank, or if you do not have an email address registered with the Bank, to your OCBC Internet Banking secured mailbox; and
      4. by such other media as the Bank may deem appropriate will be as determined or specified by the Bank from time to time.
    2. The Bank reserves the right to impose charges or to revise at any time such charges for the use of the OCBC PayNow Service upon written notice to you. Such charges or revisions shall take effect from the date stated in the notice. Where you continue to access or use the OCBC PayNow Service after such notification, you shall be deemed to have agreed to and accepted such charges or revisions to such charges.
    3. The OCBC PayNow Service is provided "as is" and "as available". The Bank expressly excludes any guarantee, representation, warranty, condition, term or undertaking of any kind, whether express or implied, statutory or otherwise, relating to or arising from the access to or use of the OCBC PayNow Service or in relation to the processing of or any other matter relating to a request to receive the Transfer Amount. The Bank does not represent or warrant that:
      1. the OCBC PayNow Service will meet your requirements;
      2. the OCBC PayNow Service will always be available, accessible, function or inter-operate with any network infrastructure, system or such other services as the Bank may offer from time to time; or
      3. your use of the OCBC PayNow Service or the Bank's processing of a request to receive the Transfer Amount will be uninterrupted, timely, secure or free of any error, including without limitation that you will receive the Transfer Amount or that you will receive the Transfer Amount in a timely fashion.
    4. You acknowledge that PayNow is operated by Banking Computer Services Private Limited (the "Service Provider") and is provided by the Service Provider to the Bank and other participating banks, to enable you to access and use the OCBC PayNow Service, and that the access and use of the OCBC PayNow Service may be subject to the availability of the services of the Service Provider.
    5. You acknowledge and agree that, unless expressly prohibited by mandatory laws, the Bank shall not be liable to you for any and all losses, liabilities, costs, expenses, damages, claims, actions or proceedings of any kind whatsoever (whether direct, indirect or consequential) in respect of any matter of whatever nature and howsoever arising (whether in contract, tort, negligence or otherwise) in connection with:
      1. the provision by the Bank of or your use of the OCBC PayNow Service;
      2. the processing of any PayNow Transaction;
      3. the processing of any Registration Enquiry, Registration Request or De-Registration Request;
      4. any PayNow Transaction being considered as incomplete or any Transfer Amount failing to be credited to your PayNow Account or being transferred to a recipient other than you, whether or not arising from:
        1. your negligence, misconduct or breach of any of these Terms (including as a result of inaccurate information being provided by you); or
        2. any failure, refusal, delay or error by any third party or third party system (including PayNow or FAST payment system) through whom or which the PayNow Transaction is made;
      5. the use in any manner and/or for any purpose whatsoever by any person at any time whatsoever and from time to time of any information or data:
        1. relating to you and/or any Payer;
        2. provided by you or the Payer in the course of using the OCBC PayNow Service and/or PayNow; and/or
        3. obtained through your use of the OCBC PayNow Service and/or PayNow;
      6. any event the occurrence of which the Bank is not able to control or avoid by the use of reasonable diligence; and/or
      7. the suspension, termination or discontinuance of the OCBC PayNow Service.
    6. The Bank shall not be liable to you for any indirect, special or consequential loss, damage, costs, expenses or liability suffered or incurred by you or any third party, howsoever caused.
    7. Unless expressly prohibited by mandatory laws, the Bank's liability to you arising from or in respect of the PayNow Transaction, whether in contract, tort (including negligence or breach of statutory duty) or otherwise for any and all losses, damages or liabilities caused or arising from or in relation to the OCBC PayNow Service and/or under or relating to these Terms shall not exceed the Transfer Amount in respect of such PayNow Transaction.
    8. You shall indemnify, defend and hold harmless the Bank and its representatives, affiliates and service providers from and against any consequences, claims, proceedings, actions, losses, damages, costs (including all legal costs on an indemnity basis), liabilities or expenses, whether foreseeable or not, resulting from or arising in connection with any fault, act or omission by you (including but not limited your negligence, misconduct or breach of any of these Terms).
    9. You consent to the collection, use and disclosure of your personal data (including contact details) by the Bank, ABS (PayNow being an initiative led by it), Service Provider and each of their representatives, affiliates and service providers as required for the purposes of the OCBC PayNow Service.
    10. The Bank shall be entitled to exercise any of its rights and remedies under the OCBC Terms and Conditions governing Electronic Banking Services (including the right to withdraw, restrict, suspend, vary or modify the Electronic Banking Services (whether in whole or in part)).

Terms and Conditions for Funds Transfer via the OCBC Cross-Border PayNow Service

  • Introduction
    1. These terms and conditions ("Terms") apply to and regulate your use of the service offered by Oversea-Chinese Banking Corporation Limited Singapore (the "Bank") in accordance with these Terms ("OCBC Cross-Border PayNow Service"), which allows you to request (each such request a "Transaction Request") that the Bank carry out a transaction (a "Cross-Border PayNow Transaction") to transfer an amount specified by you (such amount, in Singapore dollars, the "Transfer Amount") from your designated OCBC bank account to the Overseas Payment Initiative Account (defined below) maintained by your designated recipient ("Overseas Recipient") with a participating bank of such nationwide initiative implemented in a country outside of Singapore as may be prescribed by the Bank from time to time (each such initiative an "Overseas Payment Initiative"), where the Overseas Recipient under such Overseas Payment Initiative is either identified through:
      1. A "Proxy" (being a unique identifier of the Overseas Recipient (such as the Overseas Recipient's mobile number) designated as such by the Overseas Recipient's bank where applicable and registered as such under the relevant Overseas Payment Initiative);
      2. such other means prescribed by the Bank from time to time.
      You may refer to this list of Overseas Payment Initiatives. For the purposes of these Terms, "relevant Overseas Payment Initiative" means, in relation to a Cross-Border PayNow Transaction, such Overseas Payment Initiative under which the intended Overseas Recipient is registered.
    2. A Cross-Border PayNow Transaction may be carried out via the OCBC Cross-Border PayNow Service pursuant to a Transaction Request submitted through the OCBC Pay Anyone™ application (or to such other Electronic Banking Service as prescribed by the Bank from time to time) by which the Overseas Recipient is identified through their relevant Proxy.

    The term "OCBC Cross-Border PayNow Service" shall be deemed to include any notifications, communications or services referred to in these Terms and/or any services, functions and features made available through such part of the Electronic Banking Services as relates to any Cross-Border PayNow Transaction. For the avoidance of doubt, the "Electronic Banking Services" shall mean the OCBC Internet Banking Service, OCBC Mobile Banking Service, OCBC Phone Banking Service, OCBC ATM Service and/or any other services provided or made available under the OCBC Terms and Conditions governing Electronic Banking Services.

    1. The OCBC Cross-Border PayNow Service is provided as part of the Electronic Banking Services, and accordingly these Terms are in addition to and shall be read in conjunction with:
      1. the OCBC Terms and Conditions governing Electronic Banking Services (any reference to the relevant Electronic Banking Service in the OCBC Terms and Conditions governing Electronic Banking Services shall include a reference to the OCBC Cross-Border PayNow Service); and
      2. (where applicable) the Terms and Conditions for OCBC Pay Anyone™ Service,
      provided that in the event of conflict or inconsistency, these Terms shall prevail over the OCBC Terms and Conditions governing Electronic Banking Services and/or the Terms and Conditions for OCBC Pay Anyone™ Service (as the case may be) to the extent of such conflict or inconsistency.
    2. You must accept and agree to these Terms, the OCBC Terms and Conditions governing Electronic Banking Services and Terms and Conditions for OCBC Pay Anyone™ Service ("OCBC PAO Service") before you are able to use the OCBC Cross-Border PayNow Service. You further agree to comply with all guidelines, policies and procedures pertaining to use of the OCBC Cross-Border PayNow Service issued by or on behalf of the Bank from time to time. You further agree that by accepting and agreeing to these Terms, you will be able to use the OCBC Cross-Border PayNow Service and unless the Bank prescribes otherwise, will be able to perform ad-hoc transfer of funds without the need for Transaction Signing (to secure and authorise transactions) or to set-up a pre-authorised account for such transfers. The Bank may still impose further security or authorisation steps (including Transaction Signing) for certain types of transfers of funds at its sole discretion (e.g. for certain transactions that the Bank deems are high risk transactions). For a Cross-Border PayNow Transaction to be conducted, you will need to:
      1. be a retail customer of the Bank with a valid and active Singapore dollar current or savings account with the Bank ("Account"); and
      2. be a valid user of the relevant Electronic Banking Service prescribed by the Bank from time to time through which the Cross-Border PayNow Transaction is to be carried out;
      3. (where appropriate) have installed the OCBC Pay Anyone™ application on your mobile phone and be a valid user of the OCBC PAO Service; and
      4. comply with these Terms,
      and the Overseas Recipient must maintain a valid and active account, and be a registered user under an Overseas Payment Initiative, with a participating bank of such Overseas Payment Initiative (each such user, a "Registered Overseas Payment Initiative User").
      As used in these Terms: (i) the term "Transaction Signing" means such security measure as may be prescribed by the Bank, which may require you to key in transaction-specific information into a Security Device to generate an OTP in order to proceed with such transaction; (ii) "Security Device" means any hardware, token or device that may be issued by or on behalf of the Bank, at any time from time to time in its sole and absolute discretion, for the purposes of authenticating your access and/or use of the OCBC Internet Banking Service; and (iii) "OTP" means each one-time password valid for one session or transaction which will be issued by the Bank through the Security Device or delivered to your designated telephone number via Short Message Service ("SMS"), or otherwise generated by or delivered via any other device, delivery channel or any means whatsoever, designated by the Bank at any time from time to time in its sole and absolute discretion.
  • Making funds transfers via the OCBC Cross-Border PayNow Service
    1. If you wish to carry out a Cross-Border PayNow Transaction, you must first submit a "Look-Up Request" through the OCBC PAO Service (or to such other Electronic Banking Service as prescribed by the Bank from time to time) to initiate the first step in making a Transaction Request, by providing such information as may be requested by the Bank (such as the Overseas Recipient's mobile number) which corresponds to the Overseas Recipient's Proxy.
    2. If the information you submit via a Look-Up Request corresponds to a Registered Overseas Payment Initiative User's registered proxy under an Overseas Payment Initiative, you will be shown (via a display on the relevant screen) a partially masked version of the name of such Registered Overseas Payment Initiative User based on the records of the relevant participating bank of the relevant Overseas Payment Initiative (for the avoidance of doubt, in respect of a successful Cross-Border PayNow Transaction, the full version of such name will be reflected in the relevant record of such Cross-Border PayNow Transaction in your statement of account). You will also be required to key in the intended amount in the relevant foreign currency which you intend the Overseas Recipient to receive ("Converted Transfer Amount"), after which you will be shown (via a display on the relevant screen): (i) the Transfer Amount (i.e. in Singapore dollars); (ii) the Converted Transfer Amount (i.e. in the relevant foreign currency) and the applicable exchange rate as determined by the Bank; and (iii) charges payable by you to the Bank for carrying out such Cross-Border PayNow Transaction. In order to submit the Transaction Request, you will be required to take such further steps as required by the Bank (such as pressing a "Pay", "Next" or "Submit" button and/or keying in your security credentials to indicate your intention to confirm and submit such Transaction Request). Before submitting a Transaction Request, you are responsible for checking the partially masked name of such Registered Overseas Payment Initiative User displayed and for ensuring that the relevant Registered Overseas Payment Initiative User is the intended Overseas Recipient of the funds, and for ensuring that: (i) the Converted Transfer Amount in the relevant foreign currency is the correct amount that you would like to pay to the Overseas Recipient; (ii) the Transfer Amount in Singapore dollars is the correct amount that you would like to pay to the Overseas Recipient and the exchange rate as determined by the Bank is acceptable to you (and the Bank shall not be liable for any exchange rate losses and/or any costs of the currency conversions, which shall at all times be borne by you); and (iii) the charges payable by you to the Bank for carrying out such Cross-Border PayNow Transaction are acceptable to you. The Bank shall be in no way liable to you for any losses, liabilities, costs, expenses damages, claims, actions or proceedings of any kind whatsoever in connection with your failure to take any and all precautions to ensure that said Registered Overseas Payment Initiative User is the intended Overseas Recipient of the funds.
    3. You acknowledge and agree that the Registered Overseas Payment Initiative User whose partially masked name is displayed shall be deemed to be the Overseas Recipient, the Bank shall have no duty to and shall not be required to take any steps to verify or seek any other confirmation from any party as to whether such Registered Overseas Payment Initiative User is the intended Overseas Recipient, and the Bank shall not be liable for transferring the Transfer Amount to such Registered Overseas Payment Initiative User even if such person is not the intended Overseas Recipient.
    4. The Bank reserves the right to impose limits on the number of Look-Up Requests you may submit. Without prejudice to any of the Bank's rights and remedies (including without limitation under paragraph 15 of the Section titled "Miscellaneous" below), the Bank reserves the right to terminate or suspend your access to and use of the OCBC Cross-Border PayNow Service where the number of Look-Up Requests submitted has reached the limit imposed by the Bank or where it considers in its sole discretion that inappropriate or suspicious use is being made of the service, such as where multiple Look-Up Requests are submitted without a Transaction Request being confirmed. You are advised to refrain from submitting multiple Look-Up Requests without submitting a Transaction Request, and to contact the Bank should you encounter any issues relating to the foregoing.
  • Automatic opt-in to transferring funds via the OCBC Cross-Border PayNow Service
    1. You acknowledge and agree that if you have:
      1. been registered by the Bank as an OCBC PayNow User (as defined in the Terms and Conditions for the Registration for the OCBC PayNow Service) in accordance with the Terms and Conditions for the Registration for the OCBC PayNow Service;
      2. designated your mobile number (or such other unique identifier as may be prescribed by the Bank from time to time) as your registered proxy under PayNow (being the Association of Banks in Singapore ("ABS")-led initiative designated and marketed as such by ABS),
      (each such registered user, a "Relevant OCBC PayNow User"), you will be automatically opted in as a user of the OCBC Cross-Border PayNow Service (each such user, an "OCBC Cross-Border PayNow User") and these Terms shall apply to each OCBC Cross-Border PayNow User.
  • Miscellaneous
    1. Once a Transaction Request has been submitted, it will be deemed irrevocable and you will not be able to withdraw, cancel or make any changes to such Transaction Request.
    2. The Bank shall be entitled, at its absolute discretion, to reject or refuse to accept or process or to cancel any Transaction Request or Cross-Border PayNow Transaction and shall not be required to give any reason for the same.
    3. In relation to PayNow Transactions (as defined in the Terms and Conditions for Funds Transfer via the OCBC PayNow Service), Non-PayNow QR Transactions (as defined in the Terms and Conditions for OCBC Pay Anyone™ Service where conducted through the OCBC Pay Anyone™ application, or as defined in the OCBC Terms and Conditions governing Electronic Banking Services where conducted through the OCBC Digital application and in either case where the relevant Third Party Provider (as defined in the Terms and Conditions for OCBC Pay Anyone™ via QR Service where conducted through the OCBC Pay Anyone™ application, or as defined in the OCBC Terms and Conditions governing Electronic Banking Services where conducted through the OCBC Digital application) is NETWORK FOR ELECTRONIC TRANSFERS (SINGAPORE) PTE. LTD. (“NETS”)), the amount that you may transfer (whether pursuant to a single or multiple Transaction Requests) is subject to a default shared aggregate daily limit of S$1,000, and should you choose to update such shared aggregate daily limit , up to a maximum shared aggregate daily limit of S$200,000 (S$300,000 for Premier customers and above).In relation to Passcode Transactions (as defined in the Terms and Conditions for OCBC Pay Anyone™ Service) and any other transaction not described above, including Cross-Border PayNow Transactions, the amount that you may transfer (whether pursuant to a single or multiple Transaction Requests) is subject to a shared aggregate daily limit of S$1,000.

      This limit is reset at midnight (Singapore time) daily. The Bank may, at its absolute discretion, alter any limit or impose additional limits on the Transfer Amount(s) that may be transferred by you, whether on a per transaction basis, per type of transaction basis, or an aggregated basis, without prior notice to you. You may refer to this table for the various daily transaction limits described above.
    4. In relation to each Transaction Request and/or Cross-Border PayNow Transaction:
      1. You hereby instruct and authorise the Bank to debit the Transfer Amount from your Account and transfer or procure the transfer of the Converted Transfer Amount to the bank account linked to the relevant Registered Overseas Payment Initiative User's registered proxy under the Overseas Payment Initiative such Registered Overseas Payment Initiative User is registered under (such account, the "Overseas Payment Initiative Account").
      2. You acknowledge and agree that the Bank need not process the Cross-Border PayNow Transaction or transfer the Transfer Amount if there are insufficient funds in your Account.
      3. The Bank shall, based on the manner of notification pursuant to paragraph 5, notify you where the Transfer Amount has been successfully debited from your Account, or the Transfer Amount has not been debited from your Account, or the Converted Transfer Amount has failed to be credited to the Overseas Payment Initiative Account (i.e. the Cross-Border PayNow Transaction is unsuccessful).
      4. If the Cross-Border PayNow Transaction is unsuccessful (as determined pursuant to paragraph 4(c)(i)) but the Transfer Amount has been debited from your Account, the Bank shall, where the Bank is in possession of the Transfer Amount or upon receipt by the Bank of the Transfer Amount, arrange for the Transfer Amount to be credited back to your Account. For the avoidance of doubt, you will not be entitled to receive any interest in respect of the Transfer Amount.
    5. You agree to receive notifications (by or on behalf of the Bank or its service providers) in relation to Cross-Border PayNow Transactions (including notifications of incomplete or unsuccessful Cross-Border PayNow Transactions) and any other request in relation to your usage of the OCBC Cross-Border PayNow Service by (i) SMS, (ii) push notification (where applicable), (iii) email, and/or (iv) such other media as the Bank may deem appropriate. All notifications to be sent to you under these Terms:
      1. by SMS will, if you have a valid mobile number registered with the Bank, be sent to such valid mobile number;
      2. by push notification (where applicable) will be sent via the OCBC Pay Anyone™ application [or OCBC Mobile Banking application ]on your mobile phone[, as the case may be];
      3. by email will, be sent to your valid email address registered with the Bank, or if you do not have an email address registered with the Bank, to your OCBC Internet Banking secured mailbox; and/or
      4. by such other media as the Bank may deem appropriate will, be as determined or specified by the Bank from time to time.
    6. The Bank reserves the right to impose charges or to revise at any time such charges for the use of the OCBC Cross-Border PayNow Service, which may include, in respect of any Cross-Border PayNow Transaction, such charges indicated to you (on the relevant screen) after you have submitted a Look-Up Request or keyed in the intended Transfer Amount or Converted Transfer Amount, or otherwise upon written notice to you. Such charges or revisions shall take effect upon your confirmation or submission of the relevant Transaction Request or from the date stated in the notice, as the case may be, and shall be non-refundable unless otherwise agreed between you and the Bank. Where you continue to access or use the OCBC Cross-Border PayNow Service, you shall be deemed to have agreed to and accepted such charges or revisions to such charges.
    7. The OCBC Cross-Border PayNow Service is provided "as is" and "as available". The Bank expressly excludes any guarantee, representation, warranty, condition, term or undertaking of any kind, whether express or implied, statutory or otherwise, relating to or arising from the access to or use of, the OCBC Cross-Border PayNow Service or in relation to the processing of or any other matter relating to any Transaction Request or Cross-Border PayNow Transaction. Without prejudice to the foregoing, the acceptance by the Bank of your submission of a Look-Up Request and/or Transaction Request does not amount to a representation or warranty by the Bank that it will, and does not impose any obligation on the Bank to, process the Cross-Border PayNow Transaction or transfer the Transfer Amount to the Overseas Recipient's Overseas Payment Initiative Account and the Bank does not represent or warrant that:
      1. the OCBC Cross-Border PayNow Service will meet your requirements;
      2. the OCBC Cross-Border PayNow Service will always be available, accessible, function or inter-operate with any network infrastructure, system or such other services as the Bank may offer from time to time; or
      3. your use of the OCBC Cross-Border PayNow Service or the processing of any Look-Up Request, Transaction Request or Cross-Border PayNow Transaction will be uninterrupted, timely, secure or free of any malware or error.
    8. You acknowledge that Overseas Payment Initiatives are operated by third party providers (each third party provider of an Overseas Payment Initiative, an "Overseas Payment Initiative Operator") and is provided by each Overseas Payment Initiative Operator to the Bank and other participating banks, to enable you to access and use the OCBC Cross-Border PayNow Service, and that the access and use of the OCBC Cross-Border PayNow Service may be subject to the availability of the services of the Overseas Payment Initiative Operators.
    9. You acknowledge and agree that, unless expressly prohibited by mandatory laws, the Bank shall not be liable to you for any and all losses, liabilities, costs, expenses, damages, claims, actions or proceedings of any kind whatsoever (whether direct, indirect or consequential) in respect of any matter of whatever nature and howsoever arising (whether in contract, tort, negligence or otherwise) in connection with:
      1. the provision by the Bank of or your use of the OCBC Cross-Border PayNow Service;
      2. the processing of any Look-Up Request, Transaction Request or Cross Border PayNow Transaction;
      3. any Cross-Border PayNow Transaction being unsuccessful or considered as unsuccessful or any Converted Transfer Amount not having been transferred to the Overseas Recipient's Overseas Payment Initiative Account or transferred to a recipient other than the intended Overseas Recipient, whether or not arising from:
        1. your negligence, misconduct or breach of any of these Terms (including as a result of inaccurate information being provided by you and/or a failure to check the partially masked name of the Registered Overseas Payment Initiative User displayed before submitting a Transaction Request); or
        2. any failure, refusal, delay or error by any third party or third party system (including any Overseas Payment Initiative Operator and/or its systems) through whom or which any Cross-Border PayNow Transaction is made;
      4. any unauthorised access and/or use of your personal computers or other access devices (including without limitation mobile phone, television and electronic wearables) and/or the OCBC Pay Anyone™ application[ and/or the OCBC Mobile Banking application];
      5. the use in any manner and/or for any purpose whatsoever by any person at any time whatsoever and from time to time of any information or data:
        1. relating to you and/or any Overseas Recipient;
        2. transmitted through your use of the OCBC Cross-Border PayNow Service; and/or
        3. obtained through your use of the OCBC Cross-Border PayNow Service;
      6. any event the occurrence of which the Bank is not able to control or avoid by the use of reasonable diligence; and/or
      7. the suspension, termination or discontinuance of the OCBC Cross-Border PayNow Service.
    10. The Bank shall not be liable to you for any indirect, special or consequential loss, damage, costs, expenses or liability suffered or incurred by you or any third party, howsoever caused.
    11. Unless expressly prohibited by mandatory laws, the Bank's liability to you arising from or in respect of each Cross-Border PayNow Transaction, whether in contract, tort (including negligence or breach of statutory duty) or otherwise for any and all losses, damages or liabilities caused or arising from or in relation to the Bank's provision of the OCBC Cross-Border PayNow Service and/or under or relating to these Terms shall not exceed the Transfer Amount in respect of such Cross-Border PayNow Transaction.
    12. You shall indemnify, defend and hold harmless the Bank and its representatives, affiliates and service providers from and against any consequences, claims, proceedings, actions, losses, damages, costs (including all legal costs on an indemnity basis), liabilities or expenses, whether foreseeable or not, resulting from or arising in connection with any fault, act or omission by you (including but not limited your negligence, misconduct or breach of any of these Terms).
    13. You represent and warrant that, in relation to each Cross-Border PayNow Transaction, you have obtained the necessary consent of the relevant Overseas Recipient to disclose such Overseas Recipient's personal data (where applicable, including contact details) to the Bank, ABS (PayNow being an initiative led by it), Banking Computer Services Private Limited (being the operator of PayNow), the participating banks of the relevant Overseas Payment Initiative, the relevant Overseas Payment Initiative Operators and each of their representatives, affiliates and service providers and for the Bank, ABS (PayNow being an initiative led by it), Banking Computer Services Private Limited (being the operator of PayNow), the participating banks of the relevant Overseas Payment Initiative, the relevant Overseas Payment Initiative Operators and each of their representatives, affiliates and service providers to use and disclose such Overseas Recipient’s personal data as required for the purposes of the OCBC Cross-Border PayNow Service.
    14. You consent to the collection, use and disclosure of your personal data (including contact details) by the Bank, ABS (PayNow being an initiative led by it), Banking Computer Services Private Limited (being the operator of PayNow), the participating banks of the relevant Overseas Payment Initiative, the relevant Overseas Payment Initiative Operators and each of their representatives, affiliates and service providers as required for the purposes of the OCBC Cross-Border PayNow Service. Without prejudice to the generality of the foregoing, you consent to the Bank’s disclosure to participating banks of Overseas Payment Initiatives and Overseas Payment Initiative Operators, and the use and retention by such participating banks of Overseas Payment Initiatives and Overseas Payment Initiative Operators, of your personal data (including details of your Account) and other information necessary for or relevant to the provision of the OCBC Cross-Border PayNow Service or any part thereof.
    15. The Bank shall be entitled to exercise any of its rights and remedies under the OCBC Terms and Conditions governing Electronic Banking Services (including the right to withdraw, restrict, suspend, vary or modify the Electronic Banking Services (whether in whole or in part)).

Terms and Conditions for Receiving Payments via the OCBC Cross-Border PayNow Service

  • Introduction
    1. These terms and conditions ("Terms") apply to and regulate your use of the service offered by Oversea-Chinese Banking Corporation Limited Singapore (the "Bank") in accordance with these Terms ("OCBC Cross-Border PayNow Service"), which allows you, if you are an OCBC Cross-Border PayNow User (as defined below), to receive payments of specified amount of funds (such amount, in Singapore dollars, "Transfer Amount") from retail customers ("Overseas Payers") of participating banks ("Overseas Payer Banks") of such nationwide initiatives implemented in a country outside of Singapore as may be prescribed by the Bank from time to time (each an "Overseas Payment Initiative") who have requested the Overseas Payer Bank to transfer the Transfer Amount to your PayNow Account (as defined below) by identifying such account through your Proxy (as defined below) or such other means prescribed by the Bank from time to time(each transfer to you of a Transfer Amount, a "Cross-Border PayNow Transaction"). For the purposes of these Terms: (i) "PayNow Account" means such valid and active account you maintain with the Bank which you have designated to be linked to your Proxy for the purposes of receiving payments pursuant to transfers under PayNow (being the Association of Banks in Singapore ("ABS")-led initiative designated and marketed as such by ABS); (ii) "relevant Overseas Payment Initiative" means, in relation to a Cross-Border PayNow Transaction, such Overseas Payment Initiative under which the Overseas Payer is registered; and (iii) the term "OCBC Cross-Border PayNow Service" shall be deemed to include any notifications, communications or services referred to in these Terms and/or any services, functions and features made available through such part of the Electronic Banking Services as relates to any Cross-Border PayNow Transaction. For the avoidance of doubt, the "Electronic Banking Services" shall mean the OCBC Internet Banking Service, OCBC Mobile Banking Service, OCBC Phone Banking Service, OCBC ATM Service and/or any other services provided or made available under the OCBC Terms and Conditions governing Electronic Banking Services.
    2. The OCBC Cross-Border PayNow Service is provided as part of the Electronic Banking Services, and accordingly these Terms are in addition to and shall be read in conjunction with:
      1. the OCBC Terms and Conditions governing Electronic Banking Services (any reference to relevant Electronic Banking Services in the OCBC Terms and Conditions governing Electronic Banking Services shall include a reference to the OCBC Cross-Border PayNow Service),
      2. (where applicable) the Terms and Conditions for OCBC Pay Anyone™ Service,
      provided that in the event of any conflict or inconsistency, these Terms shall prevail over the OCBC Terms and Conditions governing Electronic Banking Services to the extent of such conflict or inconsistency.
    3. You must accept and agree to these Terms and be registered as a Relevant OCBC PayNow User (as defined below) before you will be able to receive the Transfer Amount which is the subject of a Cross-Border PayNow Transaction. You further agree to comply with all guidelines, policies and procedures pertaining to use of the OCBC Cross-Border PayNow Service issued by or on behalf of the Bank from time to time.
  • Opt-in to receive payments via the OCBC Cross-Border PayNow Service
    1. In order to receive funds through the OCBC Cross-Border PayNow Service, you will need to:
      1. have:
        1. been registered by the Bank as an OCBC PayNow User (as defined in the Terms and Conditions for the Registration for the OCBC PayNow Service) in accordance with the Terms and Conditions for the Registration for the OCBC PayNow Service;
        2. designated your mobile number (or such other unique identifier as may be prescribed by the Bank from time to time) as your "Proxy" (being a unique identifier of you which meets the Bank's requirements which will be registered as such under PayNow). Customers of participating banks under any Overseas Payment Initiative will be able to carry out "Look-Up Requests" (being electronic requests by such customers to identify you by a partially masked version of your name based on the Bank’s records), if they are in possession of your Proxy (for the avoidance of doubt, in respect of a successful Cross-Border PayNow Transaction, the full version of such name will be reflected in the relevant record of such Cross-Border PayNow Transaction in the relevant Overseas Payer’s statement of account);
        (each such registered user, a "Relevant OCBC PayNow User");
      2. comply with the Bank's guidelines, policies and procedures pertaining to the registration of OCBC PayNow Users issued from time to time, including without limitation those set out in these Terms and the Terms and Conditions for the Registration for the OCBC PayNow Service; and
      3. comply with these Terms and the Terms and Conditions for the Registration for the OCBC PayNow Service.
      You acknowledge and agree that if you are a Relevant OCBC PayNow User and you have not (where such option is made available to you pursuant to paragraph 2 below of this Section) opted out of being a user of the OCBC Cross-Border PayNow Service or have not otherwise notified the Bank that you do not wish to be a user of the OCBC Cross-Border PayNow Service, you will be automatically opted in as a user of the OCBC Cross-Border PayNow Service (each such user, an "OCBC Cross-Border PayNow User") and these Terms shall apply to each OCBC Cross-Border PayNow User.
    2. Once you have been opted in as an OCBC Cross-Border PayNow User, you acknowledge and agree that any information you have provided in registering to be an OCBC PayNow User (as defined in the Terms and Conditions for the Registration for the OCBC PayNow Service) and/or otherwise in the course of opting in or being opted in for the OCBC Cross-Border PayNow Service, and your name based on the Bank’s records (or a partially masked thereof) may be retrieved by any third party who uses the OCBC Cross-Border PayNow Service or who uses the payment services of the banks participating in any Overseas Payment Initiatives.
  • Opt-out of receiving payments via the OCBC Cross-Border PayNow Service
    1. The Bank may, at its absolute discretion and from such date as may be notified to you by the Bank, provide you the option of opting out of being an OCBC Cross-Border PayNow User. Where (and from such date notified to you by the Bank) such option is made available to you by the Bank, you may at any time opt out of being an OCBC Cross-Border PayNow User by submitting an opt-out request through such means as may be prescribed by the Bank ("Opt-out Request") in accordance with such form and under such conditions as may be prescribed by the Bank.
    2. An Opt-out Request will be in respect of all Overseas Payment Initiatives. You acknowledge and agree that: (i) in the event that your Opt-out Request is successful, you will not be able to receive payments via the OCBC Cross-Border PayNow Service from all Overseas Payers across all Overseas Payment Initiatives (i.e. it is not possible to submit an Opt-out Request in respect of Overseas Payers under a specific Overseas Payment Initiative); and (ii) such Opt-out Request shall also constitute an "Opt-out Request" under the Terms and Conditions for Funds Transfer via the OCBC Cross-Border PayNow Service.
    3. You agree that each Opt-out Request is irrevocable once made and you will not be able to withdraw, cancel or make any changes to such Opt-out Request, unless otherwise permitted by the Bank. Without prejudice to any of the Bank's rights and remedies, you agree that the Bank may terminate your access and/or use of the OCBC Cross-Border PayNow Service (without you having submitted an Opt-out Request) from time to time, including but not limited to where you cease to be a Relevant OCBC PayNow User or when your PayNow Account is closed.
  • Receiving payment through the OCBC Cross-Border PayNow Service
    1. You agree to inform the Bank immediately of any transfers in respect of which you believe or have reason to suspect: (a) you are not the intended recipient; or (b) constitute, in whole or in part, directly or indirectly, benefits of criminal or illegal conduct. You understand that failure to do so may result in the commission of a criminal offence. Where you have not so notified the Bank, you shall be deemed to warrant that you are the intended recipient of the Transfer Amount.
    2. If a Cross-Border PayNow Transaction cannot be or is not completed for any reason, the Bank shall not be liable to you in respect of the incomplete Cross-Border PayNow Transaction, including without limitation, your non-receipt of the Transfer Amount.
    3. The Cross-Border PayNow Transaction shall be considered as incomplete if the Transfer Amount fails to be credited to the PayNow Account for any reason (whether by reason of a failure in PayNow, FAST payment system, any system of the relevant Overseas Payment Initiative Operator (defined below) or otherwise).
    4. The Bank shall be entitled, at its absolute discretion, to reject or refuse to accept or process or to cancel any request to be opted in for the OCBC Cross-Border PayNow Service and shall not be required to give any reason for the same. In addition, the Bank shall be entitled, at its absolute discretion, to reject or refuse to process any Cross-Border PayNow Transaction and shall not be required to give any reason for the same.
  • Miscellaneous
    1. You agree to receive notifications (by or on behalf of the Bank or its service providers) in relation to Cross-Border PayNow Transactions and/or the OCBC Cross-Border PayNow Service by (i) Short Message Service ("SMS"), (ii) push notification (where applicable), (iii) email, and/or (iv) such other media as the Bank may deem appropriate. All notifications to be sent to you under these Terms:
      1. by SMS will, if you have a valid mobile number registered with the Bank, be sent to such valid mobile number;
      2. by push notification (where applicable) will be sent via the OCBC Pay Anyone™ application on your mobile phone;
      3. by email will be sent to your valid email address registered with the Bank, or if you do not have an email address registered with the Bank, to your OCBC Internet Banking secured mailbox; and
      4. by such other media as the Bank may deem appropriate will be as determined or specified by the Bank from time to time.
    2. The Bank reserves the right to impose charges or to revise at any time such charges for the use of the OCBC Cross-Border PayNow Service upon written notice to you. Such charges or revisions shall take effect from the date stated in the notice. Where you continue to access or use the OCBC Cross-Border PayNow Service after such notification, you shall be deemed to have agreed to and accepted such charges or revisions to such charges.
    3. The OCBC Cross-Border PayNow Service is provided "as is" and "as available". The Bank expressly excludes any guarantee, representation, warranty, condition, term or undertaking of any kind, whether express or implied, statutory or otherwise, relating to or arising from the access to or use of the OCBC Cross-Border PayNow Service or in relation to the processing of or any other matter relating to a request to receive the Transfer Amount. The Bank does not represent or warrant that:
      1. the OCBC Cross-Border PayNow Service will meet your requirements;
      2. the OCBC Cross-Border PayNow Service will always be available, accessible, function or inter-operate with any network infrastructure, system or such other services as the Bank may offer from time to time; or
      3. your use of the OCBC Cross-Border PayNow Service or the Bank's processing of a request to receive the Transfer Amount will be uninterrupted, timely, secure or free of any error, including without limitation that you will receive the Transfer Amount or that you will receive the Transfer Amount in a timely fashion.
    4. You acknowledge that Overseas Payment Initiatives are operated by third party providers (each third party provider of an Overseas Payment Initiative, an "Overseas Payment Initiative Operator") and is provided by each Overseas Payment Initiative Operator to the Bank and other participating banks of the relevant Overseas Payment Initiative, to enable you to access and use the OCBC Cross-Border PayNow Service, and that the access and use of the OCBC Cross-Border PayNow Service may be subject to the availability of the services of the Overseas Payment Initiative Operator.
    5. You acknowledge and agree that, unless expressly prohibited by mandatory laws, the Bank shall not be liable to you for any and all losses, liabilities, costs, expenses, damages, claims, actions or proceedings of any kind whatsoever (whether direct, indirect or consequential) in respect of any matter of whatever nature and howsoever arising (whether in contract, tort, negligence or otherwise) in connection with:
      1. the provision by the Bank of or your use of the OCBC Cross-Border PayNow Service;
      2. the processing of any Cross-Border PayNow Transaction;
      3. the processing of any request to be opted in for the OCBC Cross-Border PayNow Service or any Opt-out Request;
      4. any Cross-Border PayNow Transaction being considered as incomplete or any Transfer Amount failing to be credited to your PayNow Account or being transferred to a recipient other than you, whether or not arising from:
        1. your negligence, misconduct or breach of any of these Terms (including as a result of inaccurate information being provided by you); or
        2. any failure, refusal, delay or error by any third party (including any relevant Overseas Payment Initiative Operator) or third party system (including PayNow, FAST payment system or the systems of any Overseas Payment Initiative Operator) through whom or which the Cross-Border PayNow Transaction is made;
      5. the use in any manner and/or for any purpose whatsoever by any person at any time whatsoever and from time to time of any information or data:
        1. relating to you and/or any Overseas Payer;
        2. provided by you or the Overseas Payer in the course of using the OCBC Cross-Border PayNow Service, PayNow and/or any Overseas Payment Initiative; and/or
        3. obtained through your use of the OCBC Cross-Border PayNow Service, PayNow and/or any Overseas Payment Initiative;
      6. any event the occurrence of which the Bank is not able to control or avoid by the use of reasonable diligence; and/or
      7. the suspension, termination or discontinuance of the OCBC Cross-Border PayNow Service.
    6. The Bank shall not be liable to you for any indirect, special or consequential loss, damage, costs, expenses or liability suffered or incurred by you or any third party, howsoever caused.
    7. Unless expressly prohibited by mandatory laws, the Bank's liability to you arising from or in respect of the Cross-Border PayNow Transaction, whether in contract, tort (including negligence or breach of statutory duty) or otherwise for any and all losses, damages or liabilities caused or arising from or in relation to the OCBC Cross-Border PayNow Service and/or under or relating to these Terms shall not exceed the Transfer Amount in respect of such Cross-Border PayNow Transaction.
    8. You shall indemnify, defend and hold harmless the Bank and its representatives, affiliates and service providers from and against any consequences, claims, proceedings, actions, losses, damages, costs (including all legal costs on an indemnity basis), liabilities or expenses, whether foreseeable or not, resulting from or arising in connection with any fault, act or omission by you (including but not limited your negligence, misconduct or breach of any of these Terms).
    9. You consent to the collection, use and disclosure of your personal data (including contact details) by the Bank, ABS (PayNow being an initiative led by it), Banking Computer Services Private Limited (being the operator of PayNow), participating banks of Overseas Payment Initiatives, Overseas Payment Initiative Operators and each of their representatives, affiliates and service providers as required for the purposes of the OCBC Cross-Border PayNow Service. Without prejudice to the generality of the foregoing, you consent to the Bank’s disclosure to participating banks of Overseas Payment Initiatives and Overseas Payment Initiative Operators, and the use and retention by such participating banks of Overseas Payment Initiatives and Overseas Payment Initiative Operators, of your personal data (including details of your PayNow Account) and other information necessary for or relevant to the provision of the OCBC Cross-Border PayNow Service or any part thereof. Where (and from such date notified to you by the Bank) the option to opt out of being an OCBC Cross-Border PayNow User is made available to you by the Bank pursuant to paragraph 2 of the Section titled "Opt-out of receiving payments via the OCBC Cross-Border PayNow Service"), if you do not consent to such disclosure by the Bank or such use and retention by participating banks of Overseas Payment Initiatives and Overseas Payment Initiative Operators, you shall promptly submit an Opt-out Request to the Bank. You agree and acknowledge that you will not be able to use the OCBC Cross-Border PayNow Service to receive payments from Overseas Payers if you do not consent to such disclosure by the Bank or such use and retention by the relevant participating banks of Overseas Payment Initiatives and Overseas Payment Initiative Operators.
    10. The Bank shall be entitled to exercise any of its rights and remedies under the OCBC Terms and Conditions governing Electronic Banking Services (including the right to withdraw, restrict, suspend, vary or modify the Electronic Banking Services (whether in whole or in part)).
