Terms and Conditions Governing OCBC EasiCredit iPod Touch Lucky Draw

The following terms and conditions shall apply to the OCBC EasiCredit iPod touch Lucky Draw.

1.         Eligibility and Promotion Period

1.1        The draw is open to all Eligible Customers (defined below).

1.2        The Promotion Period for the Draw shall be from 01 April 2009 to 28 September 2009 (both dates inclusive) (“Promotion Period”).

1.3        “Eligible Customers” refer to individual OCBC EasiCredit Accountholders who are in good standing with OCBC (as determined by OCBC in its sole discretion) and who meets the following criteria:

a)       made a payment by the “Payment Due Date” according to the “Minimum Payment Amount” for the statement periods stated below:

b)   payment made must be the exact amount or amount rounded up to the nearest dollar to the “Minimum Payment Amount” for that participating month.

c)   sent an SMS in the required format to the designated number as indicated below latest by 11:59 p.m. on the “Payment Due Date” for each participating month:-

1.4        Each Eligible Customer shall be entitled to one (1) chance in the Draw for each Participating month in which he fulfills the criteria as described above.

1.5        Employees of OCBC and their immediate family members shall not be eligible to participate in the Draw. In addition, employees of any partners and agencies (including, without limitation, any external auditor(s) and advertising agencies) who are directly involved in the organisation or conduct of the Draw as determined by OCBC, shall not be eligible to participate in the Draw.

1.6        In the event any accounts, including OCBC EasiCredit, belonging to an Eligible Customer is suspended, cancelled or terminated at any time for any reason whatsoever during the Promotion Period, OCBC shall at its sole discretion, cancel the eligibility for such Eligible Customer from participating in this Draw, without incurring any liability and/or without giving any prior notice. The OCBC EasiCredit Account must not be terminated on the date the Draw.

2.         Mechanics of the Lucky Draw

2.1        There shall be 10 winners who shall be entitled to receive a prize.

2.2        No winner shall be entitled to win more than one prize in the Draw.

2.3        Each Eligible Customer will be entitled to only one (1) chance per customer regardless of the number of SMS sent for that participating month.

2.4        The prizes for the Draw are – Ten (10) units of iPod touch 8GB.

2.5        OCBC shall be entitled at its sole and absolute discretion (without any obligation to provide a reason) to forfeit the prize from any winner or disqualify any individual from the Draw.

3.         Conduct of Draw

3.1        The Draw will be held on 30 October 2009 or such other date as OCBC may determine in its sole and absolute discretion.

3.2        The Draw shall be conducted at the OCBC Centre Branch or at any other location to be determined by OCBC Bank in its absolute discretion.

3.3        The winners of the Draw shall be determined on the date of the Draw. The winners will be selected at random by such means and methods (which may be manual or computerised) as OCBC may determine. OCBC shall draw reserve winner(s) in substitution of any winner who may subsequently be disqualified from the Draw.

3.4        If any prize remains unclaimed for two (2) months after the relevant date of the Draw, it will be forfeited (without any liability on the part of OCBC to any person) and it and/or the proceeds therefrom will be donated to a charitable organization to be decided at the sole and absolute discretion of OCBC. The prize winner whose prize has been forfeited is not entitled to any payment or compensation whatsoever from OCBC.

3.5        The winner shall be notified by ordinary post to their respective addresses in the records of OCBC, within one (1) month from the date of the Draw (or at such other date(s) as may be determined by OCBC in its absolute discretion).

4.         General

4.1        Each Draw winner consents to OCBC disclosing and/or publishing his/her name and his/her particulars in any manner which OCBC may deem fit for publicity purposes. Each winner agrees to co-operate with and participate in any advertising or publicity activities of OCBC relating to the Draw and agrees that OCBC may publicise the name and/or photograph of each winner in such mode and manner as OCBC considers fit.

4.2        All Draw winners expressly and irrevocably authorize and consent to OCBC to disclose their particulars to any party for the purpose of organizing, promoting and/or conducting the Draw.

4.3        Each Draw winner shall accept the Prize on an "as is" basis. OCBC Bank gives no representation or warranty whatsoever as to the quality, merchantability or fitness for purpose or any other implied terms or conditions with respect to any prize. Notwithstanding anything herein, OCBC shall not at any time be responsible or held liable for any defect or malfunction in any prize, and/or for any loss, injury, damage or harm suffered or incurred by or in connection with the use of any prize by any person. All prizes are neither transferable nor exchangeable for cash, credits or otherwise. All prizes are also subject to the terms and conditions accompanying them (if any).

4.5        OCBC reserves the right, at its discretion, at any time, without notice or assigning any reason therefor, replace or substitute the Prize in the Draw with any other prize of equal or similar value selected by OCBC.

4.6        If OCBC subsequently discovers that the individual is in fact not eligible to participate in the Draw, OCBC may at its discretion forfeit the Prize(s) (or reclaim it /them if already awarded) and award or dispose of it/them in such manner and to such person/persons as OCBC Bank deems fit. No winner shall be entitled to any payment or compensation from OCBC Bank should any prize be forfeited/reclaimed.

4.7        OCBC shall not be liable to any account holder or any other persons for any loss or damage arising in connection with the Draw, including without limitation, any error in computing any chances, any breakdown or malfunctions in any computer system or equipment. Without prejudice to the generality of the foregoing, OCBC assumes no responsibility for lost, late, misdirected, damaged, incomplete, illegible and/or postage due mail.

4.8        The decision of OCBC on all matters relating to the Draw shall be final and binding on all participants and any other persons, including, without limitation, any decision to cancel or suspend the Draw. No correspondence(s) will be entertained.

4.9        In the event of any inconsistency between these terms and conditions and any brochure, marketing or promotional material relating to the Draw, these terms and conditions shall prevail.

4.10      OCBC may at any time at its sole and absolute discretion, without notice or assigning any reason therefor, terminate this Draw, delete, vary, supplement, amend or modify any one or more of these terms and conditions in such manner as OCBC shall think fit, including without limitation, the eligibility of any customer, the bases and methods of identification of winners and any dates in connection with the Draw, the Draw period, number of Draws and Draw Date. OCBC shall not, to the extent permitted by law, be liable to for any claims, costs, expenses, loss or damage suffered by any person as a result of the aforementioned matters.

4.11      These terms and conditions shall be governed by the laws ofSingapore and the participants in the Draw irrevocably submit to the non-exclusive jurisdiction of the courts of Singapore.

4.12      A person who is not a party to any agreement governed by these terms and conditions shall have no right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce of these terms and conditions.

As of 26 February 2009
