Terms and Conditions Governing OCBC 2009 X’mas Dream DRAW Promotion (THE “DRAW”)

Promotion Period

1. The Promotion Period of the Draw shall be between 07 November 2009 and 31 December 2009 (both dates inclusive) or such other period as may be determined by Oversea-Chinese Banking Corporation Limited (the “OCBC”) in its absolute discretion.

Eligibility

2. A person who holds a OCBC generic and/or a co-brand and/or an affinity Credit Card and Uplus Credit Card (other than Private Label Cards, FairPrice Plus Cards, Debit Cards and Corporate Cards) as a principal credit card member issued by OCBC (the “Card”) whose credit card account is in good standing with OCBC (as determined by OCBC at its sole discretion) (a “Credit Cardmember”) shall be eligible to participate in the Draw. The phrase “Eligible Persons” shall refer collectively to Credit Cardmembers and Balance Transfer Account holders.

3. If any Card held by a Credit Cardmember is suspended or cancelled or terminated by OCBC for any reason whatsoever before the Draw, the Credit Card Member will not be eligible to participate in the Draw (notwithstanding that his other Cards may not have been suspended or cancelled or terminated).

4. If a Balance Transfer Account is suspended or terminated (whether by OCBC or otherwise) for any reason whatsoever before the Draw, the Balance Transfer Account holder will not be eligible to participate in the Draw.

5. The estates of deceased Eligible Persons shall not be entitled to participate in the Draw.

6. Employees of OCBC and its subsidiaries, the advertising agencies and any other parties who are directly involved in organising, promoting or conducting the Draw as determined by OCBC are not eligible to participate in the Draw.

Allocation of Lucky Draw Chances

7. One (1) chance will be allocated to an eligible Credit Cardmember for each Qualifying Transaction (defined below) charged to his/her Card account (including Qualifying Transactions charged by supplementary cardmembers under same account) during the Promotion Period.

8. Additional Fifty (50) chances will be allocated to an eligible OCBC Visa Credit Cardmember who charged a minimum of S$800 worth of Qualifying Transactions (defined below) per month during the Promotion Period. Additional chances will be allocated to an eligible Credit Cardmember for a minimum spend of S$800 charged to his/her Card account (including Qualifying Transactions charged by supplementary cardmembers under same account) during the Promotion Period.

9. Additional Sixty (60) chances will be allocated to an eligible OCBC MasterCard Credit Cardmember who charged a minimum of S$800 worth of Qualifying Transactions (defined below) per month during the Promotion Period. Additional chances will be allocated to an eligible Credit Cardmember for a minimum spend of S$800 charged to his/her Card account (including Qualifying Transactions charged by supplementary cardmembers under same account) during the Promotion Period.

10. Ten (10) chances will be allocated to each Credit Card Member who applies for and is granted a new principal Card (excluding Private Label Cards, FairPrice Plus Cards, UPlus Card, Debit Cards and Corporate Cards) during the Promotion Period. Each Card Member is only allocated up to Ten (10) chances regardless of the number of cards approved under the same Cardmember’s NRIC.

11. The qualifying transactions for the Draw include retail transactions, Mail Order/Telephone Order transactions, Internet transactions, cash advances, Dial-A-Cash transactions, funds transfer, CashWise, balance transfers but exclude interest, finance charges, annual fees, card renewal fees, cash disbursement, any other bank related fees and any return, reversal or errors-on-posting which are posted during the Promotion Period (“Qualifying Transactions”). For the avoidance of doubt, ATM withdrawal transactions from deposit accounts are excluded for this Draw.

12. Transactions made to or relating to PayAssist accounts are not eligible to participate in the Draw.

13. The number of chances allocated to an Eligible Person by OCBC shall be final and conclusive.

14. Chances awarded to an Eligible Person are not transferable.

The Draw

15. There will be one (1) draw which shall be held on 13 January 2010 at the premises of OCBC or on such other date or at such other venue as may be determined by OCBC.

16. There will be Twelve (12) prize winners for the Draw, there will only be 1 prize winner for each Prize. Each prize winner will be randomly selected by OCBC under the supervision of independent auditors. OCBC reserves the right to draw reserve winners to replace any winner subsequently found to be ineligible.

17. The results of the Draw will be published in a newspaper circulated in Singapore within fourteen (14) working days from the date of the Draw. Each prize winner will be notified by post within fourteen (14) working days from the date of the Draw which will be sent to their address specified in the records of OCBC (the “Notification Letter”).

18. Where the prize remains unclaimed for 2 months after the date of the Draw, it will be forfeited and donated by OCBC Bank to any such charitable organizations as it deems fit. . The prize winner whose prize has been forfeited is not entitled to any compensation notwithstanding non-receipt of notification.

19. One (1) prize winner shall receive one the following prizes:

20. The winner of the 500,000 KrisFlyer miles prize will be credited an equivalent of 1,250,000 OCBC$ to the Credit Card account within 30 days from the date of the Draw. KrisFlyer miles will be credited to the KrisFlyer membership account to be furnished by the Credit Cardmember and he/she is responsible for providing an accurate and valid KrisFlyer membership number. If the Principle Credit Cardmember is not a KrisFlyer member, visit www.krisflyer.com to enrol and a membership number will be assigned to him/ her immediately upon successful enrolment. OCBC Bank shall not be responsible for the Principle Credit Cardmember's miles which have been successfully credited or for the actions of Singapore Airlines in connection with but not limited to the KrisFlyer Programme.

21. The winner of the FairPrice Trolley Dash prize shall be entitled to a three (3) minute dash at a Fairprice outlet determined by the bank. The winner is permitted to bring along another person, preferably a supplementary cardmember to participate. The winner is entitled to keep all items that the winner and participant have acquired within the store in the three (3) minute dash up to the amount of S$4,000.

22. The Peugeot 207 Vive 1.4 prize excludes the Certificate of Entitlement (COE), registration fee, road tax, insurance, radio license, number plates and In-vehicle Unit. The car must be registered within two (2) months after the grand draw/promotion. The colour of the car will subject to availability at the time of collection.

23. The redemption and use of the Prizes shall be subject to these terms and conditions and such other conditions that may be imposed by OCBC or the relevant merchants. All Prizes shall be collected at the risk and cost of each winner. Each winner shall accept his/her Prize on an “as-is, where-is” basis. OCBC shall not be responsible for the quality, merchantability or the fitness for any purpose or any other aspect of the Prizes. Notwithstanding anything herein, OCBC shall not at any time be responsible or held liable for any defect or malfunction in the Prizes by any person.

24. The Prizes claimed shall not be transferable or exchangeable for cash, credit or kind. OCBC is entitled (at its discretion) to withdraw or substitute any of the Prizes with other items without prior notice and without assigning any reason therefor.

25. Notwithstanding anything herein, OCBC shall not at any time be responsible or held liable for any loss, injury, damage or harm suffered or incurred by or in connection with the use of the Prizes (or of any goods or services redeemed with the Prizes) by any person.

General

26. Each prize winner agrees to co-operate with and participate in any advertising or publicity activities of OCBC relating to the Draw and agrees that OCBC may publicise the name, IC/passport number and/or photograph of any Winner in such mode and manner as OCBC considers fit.

27. Without prejudice to these terms and conditions, all participants in the Draw expressly and irrevocably permit and authorise OCBC to disclose, reveal and divulge information regarding their particulars to the parties involved in organising, promoting and conducting the Draw for the purposes of the Draw.

28. The decision of OCBC on all matters relating to this Draw will be at its absolute discretion and will be final and binding on all participants. No correspondence shall be entertained. In the event of any inconsistency between these terms and conditions and any brochure, marketing or promotional material relating to the Draw, these terms and conditions will prevail.

29. OCBC shall not be responsible for any loss to or expenses incurred by any Eligible Person or any other person in connection with the Draw, howsoever arising, including any error in computing chances, any breakdown or malfunction in any computer system or equipment or any notice which is misdirected or lost in the post.

30. OCBC and MasterCard accepts no responsibility for any tax implications that may arise from the prizes or the use thereof. Any tax filing obligation or any tax payment due to any tax authority as a result of receipt of the prizes remain the sole responsibility of the prize winner. It is the responsibility of each prize winner to seek independent advice on the possible implications this may have on their own financial situation.

30. OCBC reserves the right at its absolute discretion to terminate this Draw or vary, delete or add to any of these terms and conditions from time to time without notice including without limitation, the eligibility of any Eligible Person, the methods of identification of the winners and the date of the Draw.

31. These terms and conditions shall be governed by the laws of Singapore and the participants in the Draw irrevocably submit to the non-exclusive jurisdiction of the courts of Singapore.

32. A person who is not a party to any agreement governed by these terms and conditions shall have no right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any of these terms and conditions.
