1. INTRODUCTION OF THE SMARTSENIOR PROGRAMME
The Programme is intended to allow members a unique experience designed with rewards, benefits, privileges especially with SmartSeniors like you in mind giving you a peace of mind today and tomorrow. The Programme advocates family harmony by creating an opportunity for caregivers to show their respect, love and more for their parents. Convenience is introduced to enable caregivers to manage their monthly allowance for their parents hassle-free.
2. COMPONENTS OF THE PROGRAMME
2.1 The Programme shall comprise of the following:
Mandatory Features
i) SmartSenior Account
ii) SmartSenior Debit Card (primary)
iii) SmartSenior Annual Programme Fee
iv) Monthly Funds Transfer Service
Optional Features
v) SmartSenior Debit Card (secondary)
The maximum number of SmartSenior Debit Cards for each SmartSenior Account is capped at two which comprises of one SmartSenior Debit Card (primary) and one SmartSenior Debit Card (secondary).
In the case of Monthly Funds Transfer Service, at least one of the SmartSenior accountholders has to sign up for the service.
2.2 Connotations
2.2.1 The connotation of SmartSenior accountholder(s) or SmartSeniors will denote joint accountholders of SmartSenior Account. These accountholders will be considered as members of the SmartSenior Programme.
2.2.2 The connotation of SmartSenior Debit Card(s) will denote SmartSenior Debit Card (primary) and SmartSenior Debit Card (secondary), if any.
3. ELIGIBILITY
3.1 Only individual(s) who opens a SmartSenior Account or is a holder of an existing SmartSenior Account will be automatically included in the SmartSenior Programme.
3.2 Such accountholders will be deemed as SmartSeniors or members of the OCBC SmartSenior Programme and thus eligible to enjoy all its benefits and privileges offered by the Programme.
3.3 The SmartSenior Account can only be opened in the names of two or more individuals, up to a maximum of four, and the SmartSenior Account must be operated by any one of the account holders singly.
3.4 All SmartSenior accountholders must be at least 18 years and above and are not undischarged bankrupts.
3.5 Notwithstanding anything to the contrary in these Terms and Conditions, the Bank shall reserve the right to reject any application without assigning any reason whatsoever.
4. FEES, CHARGES AND PAYMENTS
4.1 SmartSenior Annual Programme Fee
The Bank may charge an annual programme fee (“fee”) on each SmartSenior Account opened. This fee is processed through the SmartSenior Debit Card
(primary) as and when the SmartSenior Debit Card is issued and for each subsequent year, on the anniversary day of the SmartSenior Debit Card (Primary)
issuance date. This fee is non-refundable should there be a termination of the SmartSenior Account, any SmartSenior Card(s) or the SmartSenior Programme.
5. RULES OF PROGRAMME
5.1 Termination of membership in SmartSenior Programme
5.1.1 SmartSeniors by terminating, closing or cancelling the SmartSenior Account and/or SmartSenior Debit Card (Primary) are deemed to have terminated their membership in the SmartSenior Programme.
5.1.3 The Bank reserves the right to terminate the SmartSenior Account and correspondingly the SmartSenior Debit Card(s) in accordance with OCBC Terms and Conditions Governing Deposit Accounts and OCBC Debit Cardmembers agreement, as the case may be.
5.2 Closing of SmartSenior Account
If a SmartSenior Account is closed, the SmartSeniors are effectively terminating their memberships in the SmartSenior Programme. Accordingly all benefits and privileges associated with the Programme will cease and all SmartSenior Debit Card(s) shall be deemed cancelled with effect from the date of termination of the SmartSenior Account.
Similarly, all GIRO arrangement including Monthly Funds Transfer Service associated with the said SmartSenior Account and Easi-Pay Bill Payment Services setup on the SmartSenior Card(s) will cease accordingly with effect from the date of termination of the SmartSenior Account. Any prevailing charges imposed by the Bank, other financial institutions or participating companies associated with such termination will be borne directly by the SmartSeniors.
5.3 Mandatory SmartSenior Debit Card (primary) Requirement
5.3.1 A SmartSenior Debit Card (primary) is made mandatory in the Programme in order for SmartSeniors to be rewarded for charging their household or living expenses needed to facilitate their daily lifestyles.
5.3.2 All SmartSenior Debit Cards will only be issued to the SmartSenior accountholders. Accordingly, customers wishing to obtain a SmartSenior Debit Card must first ensure they are joint accountholders of the corresponding SmartSenior Account.
5.3.3 On-going merchant discounts associated with SmartSenior Cards will be enjoyed by SmartSeniors on presentation of the cards at our participating merchant outlets.
5.4 Cancellation of SmartSenior Card(s)
5.4.1 Instruction to cancel the SmartSenior Debit Card (Primary) can only be given by the SmartSenior Debit Card (Primary) cardholder to the Bank. Instruction to cancel the SmartSenior Debit Card (Secondary) can only be given by the SmartSenior Debit Card (Secondary) cardholder to the Bank.
5.4.2 The SmartSenior Debit Card (secondary) can be cancelled anytime without affecting membership in the SmartSenior Programme.
5.4.3 However, should a SmartSenior Debit Card (primary) be cancelled, all SmartSenior accountholders will be deemed as having cancelled all their memberships in the SmartSenior Programme and the SmartSenior Account will be closed and all monies in the account will be returned to the customer(s) provided that prior to such payment, the indebtedness of any of the SmartSenior accountholders to the Bank shall first be set-off from the credit balance.
6. SMARTSENIOR REWARDS PROGRAMME
6.1 Any existing SmartSenior Debit Cardmember whose Card Account is valid, subsisting and in the opinion of OCBC Bank in good standing, shall be eligible under the SmartSenior Rewards Programme.
6.2 Signature-based spending (“SPEND”) on the SmartSenior Debit Card (primary) and SmartSenior Debit Card (secondary) through the VISA network will qualify for rewards for the semi-annual qualifying periods ending 31 December and 30 June for each calendar year. For SmartSenior Debit Card (primary) and SmartSenior Debit Card (secondary) issued during the qualifying periods, notwithstanding the fact that the qualifying period is less than six-months, the SmartSeniors will still qualify for the rewards for the periods ending 31 December and/or 30 June whichever comes first. Once the qualifying period has ended, all unutilised or remaining SPEND (after rewards) will lapse and cannot be exchanged for cash or carried forward into the next qualifying period or transferred to any other person (s) or reward system by the Bank.
6.3 SPEND on SmartSenior Debit Card (primary) and SmartSenior Debit Card (secondary) will not be aggregated for purpose of computing the rewards in the Programme for the qualifying period. Each SmartSenior Debit Card will be entitled to its own computation and thus rewards.
6.4 For purpose of computation of SPEND on SmartSenior Debit Card (primary) and SmartSenior Debit Card (secondary) in order to compute the rewards in the Programme, the following purchases, transactions, charges etc. will not qualify as SPEND and thus will not be taken into consideration:
i) SmartSenior Annual Programme Fee processed through the SmartSenior Debit Card (primary);
ii) Interest, late payment charges, goods and services taxes, cash advances, balance transfers, other fees and charges;
iii) Purchases and transactions made on SmartSenior Debit Card(s) which are yet to be deducted, such as earmarked amount (s), from SmartSenior Account; and
iv) Personal-Identification-Number (“PIN”) based transactions made via the NETS network or cash withdrawals made on ATMs.
6.5 The first qualifying period shall commence from the Programme launch date and end on 31 December 2009. SmartSeniors will be required to incur the necessary SPEND in order to qualify for the rewards.
6.6 The Bank reserves the right to issue the rewards to the SmartSenior Card holder(s) in any form or through any means. In the event the rewards are issued in the form of voucher(s), the Bank is not obliged to replace any voucher(s) issued which has been lost, defaced, torn or damaged or stolen for whatever reason.
6.7 All SmartSenior Card(s) issued under the SmartSenior Programme will not be eligible to participate in other Rewards Programme such as OCBC$ Rewards Programme, Robinsons Rewards Programme, LinkPoints Rewards Programme.
6.8 Similarly, in the case of termination of the SmartSenior Programme by the SmartSeniors, all rewards accumulated on the SmartSenior Card(s) will be forfeited and not transferable to any other person(s) or other OCBC Cards.
6.9 Details of the SmartSenior Rewards can be found at www.ocbc.com. The Bank reserves the right to change or suspend the reward system for this Programme or replace any rewards with another reward of similar value as and when determined by the Bank.
6.10 The Bank is not an agent of the Merchant or vendor and shall not in any way be liable or responsible for the quantity, quality, and merchantability, fitness purpose of any voucher or the acts or default of the Merchant. Any dispute relating to the quantity, quality or performance or failure of the Merchant should be resolved directly with the Merchant.
6.11 The Bank reserves the right to revoke and/or deduct and/or recompute any rewards in the event a SmartSenior fails to effect due payment for the
transaction made on SmartSenior Card(s).
7. OTHER TERMS AND CONDITIONS
7.1 These Terms and Conditions should be read in conjunction with OCBC Terms and Conditions Governing Deposit Accounts, Terms and Conditions Governing Electronic Banking Services – Personal, OCBC Debit Cardmembers Agreement, OCBC Easi-Pay Bill Payment Services and OCBC Privileges terms and conditions. In the event of any conflict, these Terms and Conditions shall prevail.
8. GENERAL
8.1 The Bank may at any time at its absolute discretion and upon written notice to the customer, change any one or more of these Terms and Conditions. Such change(s) shall take effect from the date stated in the notice, which in most instances shall be no less than 30 days from the date of the notice.
Where the customer (a) continue to operate the SmartSenior Account and/or (b) continue to utilize the SmartSenior Card(s) after such notification, the customer shall be deemed to have agreed with and accepted the amendments. If the customer does not accept any such amendments, the customer shall forthwith (a) discontinue operating the SmartSenior Account and/or (b) discontinue utilizing the SmartSenior Card(s) and instruct the Bank to terminate the SmartSenior Account.
The Bank may notify the customer of any changes to these Terms and Conditions by:
(i) publishing such changes in the Statements of Account to be sent to the customer;
(ii) displaying such changes at the Bank’s branches or automated teller machines;
(iii) posting such changes on the Bank’s website;
(iv) electronic mail or letter;
(v) publishing such changes in any newspapers; or
(vi) such other means of communication as the Bank may determine in its sole and absolute discretion.
8.2 If the Bank subsequently discovers that any person is in fact not eligible to participate in the Programme or entitled to any reward, benefit and privileges, the bank may at is discretion forfeit such reward, benefit and privileges (or reclaim it/them if already awarded or enjoyed) and award or dispose or cancel it/them in such manner and to such person/persons as the Bank deems fit. No person shall be entitled to any payment or compensation from the Bank should any reward, benefit and privileges be forfeited.
8.3 The Bank shall not be liable to any SmartSenior or any other persons for any loss or damage arising in connection with the Programme, including without limitation, any error in computing any chances, any breakdown or malfunction in any computer system or equipment. Without prejudice to the generality of the foregoing, the Bank assumes no responsibility for lost, late, misdirected, damaged, incomplete, illegible and/or postage-due mail.
8.4 The decision of the Bank on all matters relating to the Programme shall be final and binding on all SmartSeniors of the Programme, including, without limitation, any decision to cancel or suspend the Programme. Subject to and without prejudice to the generality of the foregoing, the Bank’s record(s) relating to the Programme shall be final, binding and conclusive for all purposes and in any legal proceedings. No correspondence will be entertained.
8.5 In the event of any inconsistency between these Terms and Conditions and any brochure, marketing or promotional material relating to the Programme, these Terms and Conditions shall prevail.
8.6 The Bank’s decision on all matters relating to or in connection with the Programme shall be final and binding on the SmartSenior(s).
8.7 The Bank may at any time at its absolute discretion, without notice or assigning any reason therefore, delete, vary, supplement, amend or modify any one or more of these terms and conditions in such manner as the Bank shall think fit, including without limitation, the eligibility of any SmartSenior, the bases and methods of identification of any person who is eligible to receive rewards under the Programme. The Bank shall not, to the extent permitted by law, be liable to for any claims, costs, expense, loss or damage suffered by any person as a result of the aforementioned matters.
8.8 Each SmartSenior shall cooperate with the Bank and participate in any advertising or publicity activities of the Bank in relation to the Programme and agrees that the Bank may publicise the name, NRIC/passport number and/or photograph of the SmartSenior in such mode and manner as the Bank considers fit.
8.9 Without prejudice to these Terms and Conditions, all members in the Programme expressly and irrevocably permit and authorise the Bank to disclose, reveal and divulge information regarding their particulars to the parties involved in organizing, promoting and conducting the Programme or to such other third parties as the Bank deems necessary.
8.10 These terms and conditions shall be governed by the laws of Singapore and the SmartSeniors in the Programme irrevocably submit to the non-exclusive jurisdiction of the courts of Singapore.
8.11 A person who is not a party to any agreement governed by these terms and conditions shall have no right under the Contracts (Right of Third Parties) Act (Cap 53B) to enforce any of these terms and conditions. The bank reserves the right, at its discretion, at any time, without notice or assigning any reason there.
