The following terms and conditions shall apply to the OCBC Robinsons Visa Platinum Card “Driven by Style” Lucky Draw 2010 (the "Draw").
1. Eligibility
1.1 Existing and New Principal OCBC Robinsons Visa Platinum
Cards, OCBC Robinsons Visa Platinum Elite Cards and Robinsons Cards are
eligible for the Draw (the “Eligible Cards”).
1.2 All OCBC Robinsons Visa Platinum/ Platinum Elite Card and
Robinsons Card accounts held by employees of OCBC Bank and Robinsons Group of
Stores and their immediate family members shall not be eligible for the Draw.
Ex-OCBC Bank/or Robinsons Group of Stores employee accounts are eligible for
the Draw only after such ex-employee’s staff indicator has been removed from
OCBC Bank’s and Robinsons’ Group of stores’ records.
There will not be any retrospective valuation of chances for ex-employee or
customer card accounts. In addition, the Card accounts held by employees of any
partners, sponsors and agencies (including, without limitation, any external
auditor(s) and advertising agencies) who are directly involved in the organization,
the Draw or the conduct of the Draw as determined by OCBC Bank shall not be
eligible for the Draw.
2. Qualifying Period
The Qualifying Period shall
be between 16th April 2010 and 31st July 2010 (both dates
inclusive) or such other period as may be determined by OCBC Bank in its
absolute discretion.
3. Allocation of Lucky Draw Chances (the
“Chances”)
3.1 New Principal OCBC Robinsons Visa Platinum Card Accounts
approved by Oversea-Chinese Banking Corporation Limited (“OCBC”) between 16th
April 2010 and 31st July 2010 (both dates inclusive) or such other period as
may be determined by OCBC Bank at its absolute discretion will be accorded
TWENTY (20) Chances upon approval.
3.2 No additional Chances will be earned for
any Supplementary Cards applied and approved during the Qualifying Period.
3.3 Each Eligible Robinsons Card Account/OCBC Robinsons Visa
Platinum/Platinum Elite Card Account will be accorded TEN (10) Chances for
every S$100 charged less refunds to the Card at Robinsons Raffles City or
Robinsons Centrepoint during the Qualifying Period.
3.4 For installment payment plans, Chances will only be
accorded for the installment amounts that are billed to the Eligible Card accounts
during the Qualifying Period.
3.5 All relevant Chances in relation to the
Draw already allocated to any Eligible Card account will be completely
disqualified/ forfeited from the Draw immediately upon (i) such account failing
at any time during the Draw to qualify as an Eligible Card account and/or (ii)
termination howsoever of such account (unless OCBC Bank determines otherwise in
its sole and absolute discretion).
3.6 OCBC Bank maintains the right, at it
sole and absolute discretion, to effect any adjustments, forfeitures or disqualification
of the Chance(s) earned by any Eligible Card account. The
number of Chance(s) allocated to each Eligible Card account by OCBC Bank in its
records shall be final and conclusive.
4 Conduct of Draw
4.1 The Draw will be conducted on 16th
August 2010 (Monday) or such other items or dates as may be determined by OCBC
Bank at its sole and absolute discretion
All Draws will be conducted
at OCBC Bank Limited, 18 Church
Street #05-00, S049479 or such other venues as may
be determined by OCBC Bank at its sole and absolute discretion.
4.2 Winning Eligible Card accounts (the
“Winning Card Accounts”) shall be selected at random, either by means of a
computerized system or by such other means and method (which may be manual or
computerized) as OCBC Bank may determine.
The selection process will be witnessed by an external auditor engaged by
OCBC Bank. OCBC Bank reserves the right
to draw reserve winner(s) to substitute any Winning Card Account(s)
subsequently found to be disqualified from the Draw.
4.3 The prizes of the Draws shall be
claimed by all Winning
Card Account holders in person at a venue determined by OCBC Bank and notified
by post to each Winning Card Account holder.
4.4 If any prize remains unclaimed for thirty
(30) calendar days after the date of the relevant Draw, it will be forfeited
(without any liability on the part of OCBC Bank to the relevant Winning Card Account
holder). Winning Card Account holders
whose prize has been forfeited is not entitled to any payment or compensation
whatsoever from OCBC Bank.
4.5 The results of the Draw will be
published in a major newspaper in Singapore as determined by OCBC Bank within 7
working days of the Draw date.
5 Draw Prizes
5.1 The Draw Prize will consist of ONE (1) Audi A5 Sportback, exclusive
of COE, road tax and car insurance. The color of the car will be determined by
OCBC Bank.
5.2 Notwithstanding any provision to the
contrary, OCBC Bank reserves the right at any time and from time to time to
conduct additional Draws pursuant to which extra chances will be allocated, or
to change the prizes on such terms and conditions to be notified by OCBC Bank,
and notwithstanding that such terms and conditions may differ from the terms
and conditions set out herein.
6. General
6.1 As a participant in the Draw, the prize winner
hereby authorizes OCBC Bank to disclose and publicize his/her name and any
other particulars determined by OCBC Bank (including without limitation his/her
photograph(s) to any persons and in any mode and manner as OCBC Bank may deem
appropriate.
6.2 The prize winner also agrees to
co-operate with and participate in publicity activities organized by OCBC Bank
in relation to the Draw without compensation whatsoever.
6.3 The prize is neither transferable nor
exchangeable for credits or otherwise, unless otherwise permitted by OCBC Bank
in its sole and absolute discretion. All prizes are also subject to the terms
and conditions accompanying them (if any).
6.4 OCBC Bank reserves the right, at its
discretion, at any time, without notice or assigning any reason therefore,
replace or substitute the prize in the Draw with any other prize of equal or
similar value selected by OCBC Bank.
6.5 If OCBC Bank subsequently discovers
that a prize winner is in fact not eligible to participate in any one or more
of the Draw(s), OCBC Bank may at its discretion forfeit the prize(s) (or
reclaim it /them if already awarded) and award or dispose of it/them in such
manner and to such person/persons as OCBC Bank deems fit. No person shall be
entitled to any payment or compensation from OCBC Bank should any cash prize(s)
be forfeited/reclaimed.
6.6 OCBC Bank shall not be liable to any Card
Account holder or any other persons for any loss or damage arising in
connection with the Draw, including without limitation, any error in computing
any chances, any breakdown or malfunctions in any computer system or equipment.
Without prejudice to the generality of the foregoing, OCBC Bank assumes no
responsibility for lost, late, misdirected, damaged, incomplete, illegible
and/or postage-due mail.
6.7 The decision of OCBC Bank on all
matters relating to the Draw shall be final and binding on all account holders
of the Eligible Card Accounts and any other persons, including, without
limitation, any decision to cancel or suspend the Draw or any Draw(s). Subject to and without prejudice to the
generality of the foregoing, OCBC Bank's record(s) of the entries and/or the
Draw shall be final, binding and conclusive for all purposes and in any legal
proceedings. No correspondence(s) will be entertained.
6.8 In the event of any inconsistency
between these terms and conditions and any brochure, marketing or material
relating to the Draw, these terms and conditions shall prevail.
6.9 OCBC Bank shall not be responsible for
the quality, merchantability or the fitness for any purpose or any other aspect
of any prize. Notwithstanding anything herein, OCBC Bank shall not at any time
be responsible or held liable for any defect or malfunction in any prize and/or
for any loss, injury, damage or harm suffered or incurred by or in connection
with the use of any prize by any person
6.109 OCBC Bank may at any time at its
absolute discretion, without notice or assigning any reason therefore, delete,
vary, supplement, amend or modify any one or more of these terms and conditions
in such manner as OCBC Bank shall think fit, including without limitation, the
eligibility of any customer, the bases and methods of determination of
eligibility and any dates in connection with the Draw. OCBC Bank shall not, to
the extent permitted by law, be liable to for any claims, costs, expenses, loss
or damage suffered by any person as a result of the aforementioned matters.
6.110 These terms and conditions shall be
governed by the laws of Singapore
and the participants in the Draw irrevocably submit to the non-exclusive
jurisdiction of the courts of Singapore.
6.124 A person who is not a party to any
agreement governed by these terms and conditions shall have no right under the
Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any of these terms
and conditions.
