1. Eligibility
1.1 This Promotion is open to all OCBC Customers as defined in these terms and conditions only. The Promotion shall commence from 10 May 2008 and end on 30 April 2009, or any other date as the Bank may determine in its sole discretion (the “Promotion Period”).
1.2 “OCBC Customer” means a person who:-
a. is an existing customer with at least one savings account under the Mighty SaversTM Programme with a minimum deposit amount of S$1,000 made during the Promotion Period; or
b. opens a new savings account under the Mighty SaversTM Programme which fulfills the minimum initial deposit of S$1,000.
2. Mechanics
2.1 A minimum S$1,000 deposit is required during the month which the child’s birthday fall.
2.2 For the purpose of this Promotion, the minimum deposit amount of S$1,000 to be made in one deposit.
2.3 The OCBC Mighty SaversTM Birthday gift is limited to 1 per customer and is available whilst stocks last and on a first-come-first-serve basis.
2.4 The deposited amount shall not be withdrawn within six (6) months from the date of the deposit.
2.5 In the event the deposits are withdrawn within the six (6) months period, an administrative fee of S$5, or any other amount as determined by the Bank in its sole discretion, will be imposed for every S$1,000 withdrawn from the account.
2.6 This Promotion is not applicable with other promotions.
3. General
3.1 OCBC Bank reserves the right, at its discretion, at any time, without notice or assigning any reason therefore, replace or substitute any gift in the Promotion with any other gift of equal or similar value selected by OCBC Bank.
3.2 If OCBC Bank subsequently discovers that the individual is in fact not eligible to participate in the Promotion, OCBC Bank may at its discretion forfeit the gift(s) (or reclaim it/them if already awarded) and award or dispose of it/them in such manner and to such person/persons as OCBC Bank deems fit.
3.3 OCBC Bank shall not be liable to any account holder or any other persons for any loss or damage arising in connection with the Promotion, including with limitation, any error in computing, any changes, any breakdown or malfunctions in any computer systems or equipment. Without prejudice to the generality of the foregoing, OCBC Bank assumes no responsibility for lost, late, misdirected, damaged, incomplete, illegible and / or postage-due mail.
3.4 Without prejudice to the generality of the foregoing, OCBC shall not at any time be responsible or be held liable for any damage or defect in any gift, and/or for any damage or harm suffered or incurred by or in connection with the use of any Gift by any person.
3.5 The decision of OCBC Bank on all matters relating to the Promotion shall be final and binding on all OCBC Customers and any other persons, including, without limitation, any decision to cancel or suspend the Promotion. No correspondence(s) will be entertained.
3.6 The event of any inconsistency between these terms and conditions and any brochure, marketing or promotional material relating to the Promotion, these terms and conditions shall prevail.
3.7 OCBC Bank may at any time at its sole and absolute discretion, without notice or assigning any reason therefore, delete, vary, supplement, amend or modify any one or more of these terms and conditions. OCBC Bank shall not, to the extent permitted by law, be liable to for ay claims, costs, expenses, loss or damage suffered by any person as a result of the aforementioned matters.
3.8 These terms and conditions shall be governed by the laws ofSingapore and the participants in the Promotion irrevocably submit to the non-exclusive jurisdiction of the courts of Singapore.
3.9 A person who is not a party to any agreement governed by these terms and conditions shall have no right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any these terms and conditions.
