Terms and Conditions Governing OCBC “Win an iPhone!” Lucky Draw

1. The OCBC "Win an iPhone!" Lucky Draw ("Draw") is open to all Singapore citizens and residents (collectively, the "Eligible Persons" and each, an "Eligible Person") who is aged 21 and above.
2. The promotion period for the Draw is from 7 January 2009 to 31 March 2010, both dates inclusive (the "Promotion Period").
3. A chance to win an iPhone 3GS (16GB) will be allocated to each Eligible Person who participate in the lucky draw by sending an Electronic Short Message Service (SMS) containing the keyword ‘iPhone’ and NRIC to 72222; during the Promotion Period. Each Participant will be allocated only once chance regardless of the number of SMS sent to the Bank. Additional chance will be allocated to each Eligible Person who successfully opened an EasiCredit account.
4. OCBC employees and their immediate family members are not eligible under the Draw.
5. Employees or staff of external auditors who are directly involved in the Draw and the advertising agencies of OCBC and any other party directly involved in organising, promoting or conducting the Draw are also not eligible for the Draw.
6. The Draw will be conducted on 15 April 2010 at OCBC Centre Branch 65 Chulia St #01-00 OCBC Centre Singapore 049513 at 3:00pm (or on such other date or time or at such other venue as may be determined by OCBC Bank) and one (1) winning Eligible Person will be selected at random by such means and methods (which may be manual or computerised) as OCBC Bank may determine in the presence of OCBC Bank's auditors. OCBC Bank reserves the right to draw reserve winners to replace any winner subsequently found to be disqualified. The winner will be notified by post (to his/her respective address in the records of OCBC) within 5 working days from the date of the Draw.
7. 3 winners will be selected for the draw and each winner will be entitled to an iPhone 3GS (16GB) worth $1,040. Where the Cash Prize remains unclaimed for 2 months after the date of the Draw, it will be forfeited and donated to any charitable organization as OCBC may determine  
8. If any person is subsequently discovered to be not entitled or ineligible to participate in the Draw or ineligible to receive the prize, OCBC reserves the right to forfeit/reclaim the prize at its discretion and confer the same on any other person as may be selected by OCBC Bank in any manner as OCBC Bank deems fit. No person shall be entitled to any payment or compensation from OCBC should any prize be forfeited.
9. OCBC may at its sole discretion substitute or replace any prize with any other prize of equal or similar value (in kind) selected by it without prior notice. Unless otherwise indicated by OCBC Bank, all prizes are non-transferable and are not exchangeable for cash or for any other item.
10. The winner agrees to co-operate with and participate in any advertising or publicity activities of OCBC relating to the Draw and agrees that OCBC may publicise the name and/or photograph of each winner in such mode and manner as OCBC considers fit.
11. Without prejudice to these terms and conditions, all participants in the Draw expressly and irrevocably permit and authorise OCBC to disclose, reveal and divulge information regarding their particulars to the parties involved in organising, promoting and conducting the Draw for the purposes of the Draw.
12. OCBC's decision on all matters relating to this Draw will be at its absolute discretion and will be final and binding on all participants. No correspondence shall be entertained. In the event of any inconsistency between these terms and conditions and any brochure, marketing or promotional material relating to the Draw, these terms and conditions will prevail.
13. OCBC reserves the right at its absolute discretion to terminate this Draw or vary, delete or add to any of these terms and conditions from time to time without notice including without limitation, the eligibility of any person, the bases and methods of identification of winners and the dates of the Draw.
14. OCBC shall not be liable for any loss or damage arising in connection with the Draw, including any act or omission relating to any person's participation howsoever caused, any error in computing any draw chances, any breakdown or malfunction in any computer system or equipment and any notice which is misdirected or lost in the post.
15. By taking part in the Draw, the participant authorizes OCBC to conduct credit checks and verify information given in this application with any party (including, without limitation, with any credit bureau or any other organisation or corporation set up for the purpose of collecting and providing information relating to the credit standing of persons) without reference to me.
16. By taking part in the Draw, the participant irrevocably and unconditionally consent for OCBC and any officer (as defined in the Banking Act Cap 19) (The “Banking Act”) of OCBC to disclose any customer information whatsoever relating to themselves as OCBC shall consider appropriate to any person to whom disclosure is permitted or required by any statutory provision or law or to any other person wherever situate for any purpose whatsoever and it is hereby agreed that OCBC and any officer of OCBC may disclose the foregoing information to the fullest extent permitted by the Banking Act or any statutory provision or law. Without prejudice to the foregoing, they consent to such disclosure to any credit bureau or any other organization or corporation set up for the purpose of collecting and providing information relating to the credit standing of persons and to the disclosure by such credit bureau or other organization or corporation to any member thereof, for the purposes of assessing their credit worthiness or for other purposes whatsoever. 
17. These Terms and Conditions shall be governed by Singapore law and the participants in the Draw irrevocably submit to the non-exclusive jurisdiction of the courts of Singapore. A person who is not a party to any agreement governed by these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any of these Terms and Conditions.
