Terms and Conditions
Governing the “OCBC Cash Advance Fee
Waiver Promotion
November 2009” (the “Promotion”)
1
Eligibility
Only the following customers may
qualify for the Promotion:-
1.1
Existing OCBC
principal
credit cardmember who has received a direct mailer, inviting him/her
to participate in this Promotion
and
1.2
Whose OCBC
Credit Card
account is in good standing with OCBC within the promotion period shall be eligible
to participate in the
Promotion (an “Eligible Cardmember”).
The OCBC Fairprice Plus Cards,
UPlus, Debit Cards, Corporate Cards and Private Label Cards are
not eligible for this Promotion.
2.
Promotion
Qualifying Periods
The Promotion
Period shall be
between 23 November 2009 and 31 December 2009 (both dates inclusive) or
such
other period as may be determined by Overseas-Chinese Banking
Corporation
Limited (“OCBC”) in its absolute discretion.
3.
Awarding of
Waiver
Under the
Promotion, an amount equivalent to the any Cash
Advance fee(s) charged during the Promotion Period shall be credited
into the
respective account of the Eligible Cardmember by 31 January 2010.
4.
General
4.1
OCBC Bank's decision on all matters relating to each
Program
will be final and binding on all participants. Without prejudice to the
generality of the foregoing, OCBC Bank's record(s) shall be conclusive
for all
purposes and be binding on all participants.
4.2
OCBC Bank reserves the right at its absolute discretion to
terminate each Program or vary, delete or add to any of these terms and
conditions from time to time without notice.
4.3
OCBC
Bank shall not be responsible for any loss to any person in connection
with each
Program howsoever arising, including any error in computing chances,
any
breakdown or malfunction in any computer system or equipment, any
notice which
is misdirected or lost in the post.
4.4
In the event of any inconsistency between these terms and
conditions and any brochure, marketing or promotional material relating
to each
Program, these terms and conditions will prevail.
4.5
These terms and conditions shall be governed by the laws
of Singapore
and the participants shall irrevocably
submit to the non-exclusive jurisdiction of the courts of Singapore.
A
person who is not a party to any agreement governed by these terms and
conditions shall have no right under the Contracts (Rights of Third
Parties)
Act (Cap 53B) to enforce any of these terms and conditions.
