TERMS AND CONDITIONS GOVERNING ASK OCBC “I LOVE CYCLING” PHOTO CONTEST (the “CONTEST”)

1. The Contest period will be from 8 January 2010 to 15 February 2010 (both dates inclusive).
2. Each participant confirms that he/she is the sole owner of or has control of all copyrights and any other rights in the photograph which he/she has submitted to OCBC Bank for the purposes of the Contest.
3. One email entry to AskOCBC@ocbc.com per participant. Multiple entries will be disqualified.
4. Only entries submitted to AskOCBC@ocbc.com are eligible.
5. Winners will be selected by OCBC Bank at its sole discretion. They will be contacted by telephone by 15 March 2010 with instructions on how to redeem the prizes.
6. The top prize is an OCBC Cycle Singapore 2010 cycling jersey, second prize is an OCBC Cycle Singapore 2010 cycling tights and third prize is a set of OCBC Cycle Singapore 2010 gloves and socks.
7. The top 3 winning entries will be featured in the next issue of Ask OCBC (April – June 2010).
8. All prizes are neither transferable nor exchangeable for cash, credits, or otherwise. All prizes are also subject to the terms and conditions accompanying them (if any).
9. Each winner hereby authorises OCBC Bank to disclose to any persons to publicise his/her name, photograph and any other particulars determined by OCBC Bank in any mode and manner as OCBC Bank may deem appropriate and, further agree to co-operate with and participate in advertising or publicity activities organised by OCBC Bank in relation to this Ask OCBC Quarterly – “I Love Cycling” Photo Contest without compensation whatsoever.
10. Each winner shall accept the prize on an “as is” basis. OCBC Bank gives no representation or warranty whatsoever as to the quality, merchantability or fitness for purpose or any other implied terms or conditions with respect to any prize and OCBC Bank shall not be responsible for the quality, merchantability or the fitness for any purpose or any other aspect of any prize. Notwithstanding anything herein, OCBC Bank shall not at any time be responsible or held liable for any defect or malfunction in any prize, and/or for any loss, injury, damage or harm suffered or incurred by or in connection with the use of any prize by any person.
11. OCBC Bank reserves the right, at its discretion, at any time, without notice or assigning any reason therefore, replace or substitute any prize in the Contest with any other prize of equal or similar value selected by OCBC Bank.
12. If any prize remains unclaimed for two (2) months after the notification, it will be forfeited and/or the proceeds there from will be donated to a charitable organization to be selected at the sole and absolute discretion of OCBC Bank. The prize winner whose prize has been forfeited is not entitled to any payment or compensation whatsoever from OCBC Bank.
13. If OCBC Bank subsequently determines that a person is in fact not eligible for any prize, for any reason whatsoever, OCBC Bank may at its discretion reclaim the prize and award or dispose of it in such manner and to such person/persons as OCBC Bank deems fit in its sole discretion.
14. This offer is not valid with other OCBC Bank promotions that may be running concurrently.
15. No person shall be entitled to any payment or compensation from OCBC Bank should any prize be forfeited or reclaimed. Without prejudice to the generality of the foregoing, OCBC Bank reserves the right to disqualify any person from the Contest if in the opinion of OCBC Bank there has been any fraud or breach of these terms and conditions.
16. OCBC Bank reserves the right to terminate the Contest at any time without notice. OCBC Bank shall not be liable to any person for any loss or damage arising in connection with Contest, including without limitation, any error in computing any chances, any breakdown, or malfunctions in any computer system or equipment. Without prejudice to the generality of the foregoing, OCBC Bank assumes no responsibility for lost, late, misdirected, damaged, incomplete, illegible and/or postage-due mail.
17. The decision of OCBC Bank on all matters relating to the Contest shall be final, binding and conclusive on all participants, including, without limitation, any decision on the eligibility of any person or to cancel or suspend the Contest. Subject to and without prejudice to the generality of the foregoing, OCBC Bank's record(s) of the entries and/or the Contest shall be final, binding and conclusive for all purposes and in any legal proceedings. No correspondence will be entertained.
18. In the event of any inconsistency between these terms and conditions and any brochure, marketing or promotional material relating to the Contest, these terms and conditions shall prevail.
19. OCBC Bank may at any time at its absolute discretion, without notice or assigning any reason therefore, delete, vary, supplement, amend or modify any one or more of these terms and conditions in such manner as OCBC Bank shall think fit, including without limitation, the eligibility of any customer or participant, the bases and methods of identification of eligible participants of the Contest and any dates in connection with the Contest. OCBC Bank shall not, to the extent permitted by law, be liable to for any claims, costs, expenses, loss or damage suffered by any person as a result of the aforementioned matters.
20. All customer contact details provided pursuant to the Contest will become the property of OCBC Bank, and may be used by OCBC Bank in its sole discretion for future marketing related programs.
21. These terms and conditions shall be governed by the laws of Singapore and the participants in the Contest irrevocably submit to the non-exclusive jurisdiction of the courts of Singapore. A person who is not a party to any agreement governed by these terms and conditions shall have no right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any of these terms and conditions.
